SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the  Constitution of<br \/>\n\tIndia, the petitioners have prayed for appropriate writ, order<br \/>\n\tand\/or direction, quashing and setting aside the impugned order<br \/>\n\tdtd.15\/2\/2011 passed by the appellate authority i.e. Officer on<br \/>\n\tSpecial Duty and Joint Secretary, Urban Housing and Urban<br \/>\n\tDevelopment Department, Gandhinagar,  in Appeal No.22 of 2010 in<br \/>\n\tdismissing the same and confirming the order passed by the<br \/>\n\tCollector, Valsad in Case No.MUN\/TP\/Case\/1 of 2010 dtd.15\/10\/2010.\n<\/p>\n<p>\tFacts<br \/>\n\tleading to the present petition, in nutshell are as under:-\n<\/p>\n<p>\tThat<br \/>\n\ta development permission was granted to the private respondents on<br \/>\n\t21\/4\/2010 by the Valsad Nagar Palika, which according to the<br \/>\n\tpetitioners   was on the basis of illegal resolution and mainly on<br \/>\n\tthe ground that  the said development permission was granted on the<br \/>\n\tbasis of Circular Resolution and it was not even  placed before the<br \/>\n\tTown Planning Committee.\n<\/p>\n<p>\tThat<br \/>\n\tthe petitioners   challenged the said Resolution \/ Development<br \/>\n\tPermission before the District Collector, Valsad under sec.6(B) of<br \/>\n\tthe Gujarat Town Planning  and Urban Development Act, on the ground<br \/>\n\tthat  by permitting the private respondents to put up construction,<br \/>\n\tthe property of the petitioners   is likely to be damaged. That the<br \/>\n\tCollector, Valsad by order dtd.15\/10\/2010 partly allowed the said<br \/>\n\tappeal and directed  the respondent No.2 &#8211; Madhav Co-operative<br \/>\n\t Housing Society Limited  to restore and\/or to compensate the<br \/>\n\trepairing towards the house of the petitioners, which is damaged due<br \/>\n\tto the construction being carried out by the respondent No.2. Being<br \/>\n\taggrieved by and dissatisfied with the order passed by the District<br \/>\n\tCollector, Valsad dtd.15\/10\/2010 petitioners   preferred further<br \/>\n\tappeal before the State Government under sec.6(B)(4) of the Gujarat<br \/>\n\tTown Planning Act, which was numbered as Town Planning Appeal No.22<br \/>\n\tof 2010.\n<\/p>\n<p>\tIt<br \/>\n\tappears that in the meantime, the Collector also directed to place<br \/>\n\tthe Resolution granting Development Permission in favour of the<br \/>\n\tprivate respondents for approval before the Town Planning Committee<br \/>\n\tand to consider whether to approve the Development Permission No.422<br \/>\n\tor not and the Town Planning Committee passed resolution No.6<br \/>\n\tdtd.9\/12\/2010  approving Development Permission No.422 granting<br \/>\n\tdevelopment permission in favour of the private respondents.\n<\/p>\n<p>\tThat<br \/>\n\tthereafter, the aforesaid Town Planning Appeal No.22 of 2010 came to<br \/>\n\tbe finally heard by the appellate authority, which was earlier<br \/>\n\tpassed by the Collector, Valsad dtd.15\/10\/2010 and the appellate<br \/>\n\tauthority dismissed the said appeal, however, by observing that if<br \/>\n\tthe petitioners are still still aggrieved by the Resolution<br \/>\n\tdtd.9\/12\/2010,  of the Town Planning Committee, the same can be<br \/>\n\tchallenged before the appropriate forum by way of appeal and by<br \/>\n\tfurther observing that if there is any damage caused to the<br \/>\n\tpetitioners   by the construction on the land bearing City Survey<br \/>\n\tNo.1965 being carried out by the respondent No.2 &#8211; Madhav<br \/>\n\tCo-operative  Housing Society Limited, it will be open for the<br \/>\n\tpetitioners   to initiate appropriate proceedings to compensate the<br \/>\n\tsame after proving the damage\/loss caused to the petitioners. Being<br \/>\n\taggrieved by and dissatisfied with the order passed by the Officer<br \/>\n\ton Special Duty &amp; Joint Secretary, Urban Housing and Urban<br \/>\n\tDevelopment Department  &#8211; appellate authority under<br \/>\n\tsection  6(B)(4) of the Town Planning Act, dtd.15\/2\/2011, the<br \/>\n\tpetitioners have preferred the present Special Civil Application<br \/>\n\tunder Article 226 \/ 227 of the Constitution of India.\n<\/p>\n<p>\tAt<br \/>\n\tthe outset, it is required to be noted that  it is the case on<br \/>\n\tbehalf of the petitioners that by granting development permission<br \/>\n\tand permitting the private respondents to put up the construction,<br \/>\n\tthe property of the petitioners   has been damaged and the<br \/>\n\tpetitioners have sustained loss and therefore, the development<br \/>\n\tpermission granted in favour of the private respondents  is required<br \/>\n\tto be  quashed and set aside. It appears that the case on behalf of<br \/>\n\tthe petitioners was that Development Permission No.422 was granted<br \/>\n\tin favour of the private respondents  on the basis of illegal<br \/>\n\tresolution as the same was not granted by the Circular Resolution<br \/>\n\tand Resolution of Town Planning Committee was not passed.  It<br \/>\n\tappears that thereafter  the question with respect to granting<br \/>\n\tDevelopment Permission No.422 was placed before the Town Planning<br \/>\n\tCommittee and subsequently by Resolution No.6 dtd.9\/12\/2010 the same<br \/>\n\thas been confirmed while dismissing the appeal by the appellate<br \/>\n\tauthority &#8211; State Government.  It is specifically observed<br \/>\n\tthat if the petitioners   are aggrieved by the said resolution of<br \/>\n\tthe Town Planning Committee dtd.9\/12\/2010, it will be open for the<br \/>\n\tpetitioners   to challenge the same.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe above, when it was pointed out to the learned advocate appearing<br \/>\n\ton behalf of the petitioners that petitioners   can challenge the<br \/>\n\tsaid resolution before the appropriate authority \/ forum, till this<br \/>\n\tCourt started dictating the order, the learned advocate appearing on<br \/>\n\tbehalf of the petitioners  did not inform the Court that as such the<br \/>\n\tsaid resolution dtd.9\/12\/2010 is already challenged by some other<br \/>\n\tresidents of the very society before the Collector, Valsad and only<br \/>\n\tat the time when the Court started dictating the order to the<br \/>\n\taforesaid,  the learned advocate appearing on behalf of the<br \/>\n\tpetitioners informed the Court that the said resolution<br \/>\n\tdtd.9\/12\/2010 is already challenged by some other persons. Be that<br \/>\n\tit may,  as observed by the appellate authority, the petitioners may<br \/>\n\tchallenge the same before the appropriate authority \/ forum and may<br \/>\n\tjoin  as party in the appeal preferred by the other persons.\n<\/p>\n<p>\tNow,<br \/>\n\tso far as the contention on behalf of the petitioners   that by<br \/>\n\tgranting development permission and permitting the private<br \/>\n\trespondents to put up the construction, property  of the petitioners<br \/>\n\t  is likely to be damaged and petitioners are likely to cause loss<br \/>\n\tand therefore, development permission is required to be quashed and<br \/>\n\tset aside is concerned, as such on the aforesaid ground, development<br \/>\n\tpermission cannot be quashed and set aside.\n<\/p>\n<p>\tIt<br \/>\n\tis to be noted that the petitioners   have failed to produce any<br \/>\n\tdocument and\/or evidence to show\/prove the extent  of damage \/ loss<br \/>\n\tcaused to them. Still a liberty is reserved  in favour of the<br \/>\n\tpetitioners to initiate appropriate proceedings for getting<br \/>\n\tcompensation for the damage caused to the petitioners, on proving<br \/>\n\tdamage\/loss. It is also observed by the authority that as such so<br \/>\n\tfar as the petitioners   are concerned, they are not concerned with<br \/>\n\tother properties except respondent No.2 &#8211; Madhav Co-operative<br \/>\n\tHousing Society Limited granting Development Permission with respect<br \/>\n\tto City Survey No.1965 and the petitioners   are not concerned with<br \/>\n\tother properties covered under the development permission  No.422.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe overall facts and circumstances of the case, it cannot be said<br \/>\n\tthat the appellate authority has committed any error and\/or<br \/>\n\tillegality in passing the impugned order. As such, liberty is<br \/>\n\treserved in favour of the petitioners   to challenge the subsequent<br \/>\n\tresolution dtd.9\/12\/2010 and\/or to initiate appropriate proceedings<br \/>\n\tand pray for compensation on proving loss\/damage to their property<br \/>\n\tand therefore, even otherwise, the interest of the petitioners   is<br \/>\n\tsufficiently protected.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, there is no substance in the present petition,<br \/>\n\twhich deserves to be dismissed and is accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t[M.R.\n<\/p>\n<p>SHAH, J.]<\/p>\n<p>rafik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ashokbhai vs State on 27 September, 2011 Author: M.R.
