Justice ANTONY DOMINIC\n\n Dated :13\/08\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n\n           --------------------------------------------------------\n\n                     W.P.(C) 22415 of 2008\n\n           --------------------------------------------------------\n\n                   Dated: AUGUST 13, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>         Petitioner&#8217;s grievance is regarding the delay on<\/p>\n<p>the part of the 1st respondent in initiating and continuing<\/p>\n<p>revenue recovery proceedings against the 3rd respondent.<\/p>\n<p>       2.  Petitioner submits that he was the claimant in<\/p>\n<p>MVOP 28\/1997 before the MACT, Pala, in which Ext.P1<\/p>\n<p>award was passed directing the 3rd respondent to pay<\/p>\n<p>compensation.        According to the petitioner, as he was<\/p>\n<p>aggrieved by Ext.P1 award, he filed an appeal as MACA<\/p>\n<p>1343\/2004 before this Court, in which the compensation<\/p>\n<p>was enhanced by Ext.P2 judgment. Despite the finality that<\/p>\n<p>the award has attained, compensation was not paid and<\/p>\n<p>therefore the petitioner sought for recovery of the amount<\/p>\n<p>due to him by taking recourse of revenue recovery<\/p>\n<p>proceedings. It is stated that though a requisition in this<\/p>\n<p>behalf was made, recovery proceedings was not initiated or<\/p>\n<p>continued and on account of the delay in this matter, this<\/p>\n<p><span class=\"hidden_text\">WP(C) 22415\/08                  2<\/span><\/p>\n<p>petition is filed praying for expediting recovery.<\/p>\n<p>        3.   The case was adjourned with a direction to the<\/p>\n<p>Government Pleader to obtain instructions in the matter.<\/p>\n<p>Today, on instructions, the learned Government Pleader<\/p>\n<p>submits that recovery proceedings have already been<\/p>\n<p>initiated, and that notice under secs.7 and 34 of the<\/p>\n<p>Revenue Recovery Act has been served on the defaulter on<\/p>\n<p>4.8.2008 and that further action in pursuance thereof will<\/p>\n<p>be continued.     From the submission made by the learned<\/p>\n<p>Government Pleader, it is therefore evident that they have<\/p>\n<p>initiated proceedings and are earnestly continuing the<\/p>\n<p>proceedings under the Revenue Recovery Act.         If that be<\/p>\n<p>so, the grievance of the petitioner is unfounded.<\/p>\n<p>        4.
