The order of the Magistrate was challenged<br \/>\n\tbefore the Sessions Court. The Sessions Court by impugned order<br \/>\n\tdated 29.04.2009 reversed the order on the ground that since the<br \/>\n\toffence under Section 306 of the Indian Penal Code is punishable<br \/>\n\twith imprisonment for a term, which may extend to 10 years,<br \/>\n\tinvestigating agency would have 90 days of period for submitting<br \/>\n\tchargesheet before the default bail can be asked for. This order was<br \/>\n\tstayed by the High Court. The petitioner, therefore, continued on<br \/>\n\tbail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the petitioner relied on the decision of this Court in<br \/>\n\tcase of Niraj Shitalkumar Mittal V\/s. State of Gujarat in Criminal<br \/>\n\tMisc. Application No.6840\/2003, in which, it is held that offence<br \/>\n\tunder Section 306 is punishable with imprisonment which may extend<br \/>\n\tto 10 years whereas sub-section (2) of Section 167 would be<br \/>\n\tapplicable in cases where  the investigation relates to an offence<br \/>\n\tpunishable with death or imprisonment for life or imprisonment for a<br \/>\n\tterm of not less than 10 years. In the said decision, it was<br \/>\n\tobserved as under :-\n<\/p>\n<p>\t 6.\tEven,<br \/>\n\taccording to the investigating agency also, the period for filing of<br \/>\n\tcharge sheet  expired  after  60 days  on 22nd August, 2003 and,<br \/>\n\ttherefore, a report was submitted to the learned Magistrate for<br \/>\n\textension of time for filing of charge sheet for a period of  30<br \/>\n\tdays  and the  learned Magistrate, exercising his judicial wisdom,<br \/>\n\tordered that report to be kept with the record. Now,  if the<br \/>\n\tposition as settled in this regard is considered, the Apex  Court<br \/>\n\tin the  case  of  Rajeev  Chaudhary,  while considering the<br \/>\n\tpunishment prescribed under  Section  386 of I.P.C., has observed<br \/>\n\tthat clause (i) of proviso (a) to Section  167(2)  of  the Code of<br \/>\n\tCriminal Procedure would cover offence for  which imprisonment  is<br \/>\n\tfor  a clear period of 10 years or more.  Under Section 386 of<br \/>\n\tI.P.C., punishment prescribed  can  extend to 10 years, i.e.  it<br \/>\n\tcould also be less than  10 years.    The  Apex  Court observed<br \/>\n\tthat  the  said  clause  (i)  of proviso (a) to Section 167(2) would<br \/>\n\tbe applicable  in cases  where  the investigation  relates  to an<br \/>\n\toffence punishable with (1) death, (2) imprisonment for life or (3)l<br \/>\n\timprisonment for a term of not less than 10 years. The  Apex Court<br \/>\n\talso observed  that  it  would not cover the offence for which<br \/>\n\tpunishment could be imprisonment for less than 10  years. Thus,  in<br \/>\n\tthe instant case, as can be seen from the above table, the<br \/>\n\tpunishment prescribed is nowhere 10  years  or more  and, therefore,<br \/>\n\tthe charge sheet ought to have been filed before completion of 60<br \/>\n\tdays, failing  which,  the applicant  would be entitled to default<br \/>\n\tbail as he cannot be remanded to judicial custody thereafter.\n<\/p>\n<p>In<br \/>\n\tview of the said decision, this petition is required to be allowed.<br \/>\n\tThe order of the Sessions Court is set aside. Disposed of<br \/>\n\taccordingly.
