Justice ANTONY DOMINIC\n\n Dated :22\/02\/2008\n\n O R D E R\n                           ANTONY DOMINIC, J.\n\n                          ===============\n\n                      W.P.(C) NO. 5225 OF 2008 V\n\n                    ====================\n\n\n             Dated this the 22ndday of February, 2008\n\n\n                               J U D G M E N T\n<\/pre>\n<p>       The   petitioner   complains   that   a   lorry   belonging   to   him<\/p>\n<p>bearing   Regn.No.KL-4\/G   8679   has   been   detained   while   it   was<\/p>\n<p>transporting  ordinary  sand. Ext.P4 is the  mahazar, in which the<\/p>\n<p>only   irregularity   that   is   alleged   is   that   it   did   not   accompany   a<\/p>\n<p>pass issued by the Revenue Divisional Officer or the Tahsildar.  In<\/p>\n<p>Ext.P5, the Geologist has stated that it is ordinary sand and not<\/p>\n<p>river   sand   which   was   transported.     However,   none   of   the<\/p>\n<p>documents   produced   by   the   petitioner   clearly   indicate   what<\/p>\n<p>proceedings  are pending in respect of the lorry in question.   Be<\/p>\n<p>that   as   it   may,   if   at   all   the   respondents   want   to   continue   the<\/p>\n<p>adjudication, they are free to do so. Pending such adjudication, I<\/p>\n<p>do not think that in the peculiar facts of this case, it is necessary<\/p>\n<p>to continue detention of the lorry.\n<\/p>\n<\/p>\n<p>       2.     Therefore,   I   direct   that   the   lorry   referred   to   above<\/p>\n<p>WPC 5225\/08<\/p>\n<p><span class=\"hidden_text\">                                      :2 :<\/span><\/p>\n<p>shall   be   released   to   its   registered   owner   on   executing   a   bond<\/p>\n<p>undertaking to produce the same as and when needed and not to<\/p>\n<p>alienate or encumber the same.
