JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/11\/2006 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p> (Per : HON&#8217;BLE MR.JUSTICE J.M.PANCHAL)<\/p>\n<p>\tAdmitted.\n<\/p>\n<p>\tMr.Ashok V.Prajapati, learned counsel, waives service of notice on<br \/>\n\tbehalf of the claimant\/ claimants in each Appeal. Having regard to<br \/>\n\tthe facts of the case, all these Appeals are taken up for final<br \/>\n\tdisposal today.\n<\/p>\n<p>\tBy<br \/>\n\tfiling these Appeals under Section 54 of the Land Acquisition Act,<br \/>\n\t1894 (?Sthe Act?? for short), read with Section 96 of the Code of<br \/>\n\tCivil Procedure, 1908, the appellants have challenged the legality<br \/>\n\tof common judgment and award dated July 1, 2005, rendered by the<br \/>\n\tlearned Joint District Judge, 3rd Fast Track Court,<br \/>\n\tPatan, in Land Acquisition Reference Case No.13\/2004 to 22\/2004, by<br \/>\n\twhich, the claimants are awarded additional amount of compensation<br \/>\n\tat the rate of Rs.45\/- per sq.mt. over and above the amount of<br \/>\n\tcompensation awarded to them by the Special Land Acquisition Officer<br \/>\n\tvide award dated November 21, 2003, at the rate of Rs.4.50 ps. per<br \/>\n\tsq.mt., for their acquired lands.\n<\/p>\n<p>\tA<br \/>\n\tproposal was received by the State Government to acquire the lands<br \/>\n\tof village Vansa, Taluka: Harij, District: Patan, for the public<br \/>\n\tpurpose of construction of Narmada canal. On scrutiny of the said<br \/>\n\tproposal, the State Government was satisfied that the lands of<br \/>\n\tvillage Vansa were likely to be needed for the said public purpose.<br \/>\n\tTherefore, a Notification under Section 4(1) of the Act was issued,<br \/>\n\twhich was published in the official gazette on April 5, 2002. The<br \/>\n\tland owners were served with notices who had opposed the proposed<br \/>\n\tacquisition. After considering their objections, a report was<br \/>\n\tsubmitted by the Special Land Acquisition Officer to the State<br \/>\n\tGovernment as contemplated by Section 5A(2) of the Act. On<br \/>\n\tconsideration of the said report, the State Government was satisfied<br \/>\n\tthat the lands of village Vansa which were specified in the<br \/>\n\tNotification published under Section 4 of the Act were needed for<br \/>\n\tthe public purpose of construction of Narmada canal. Therefore, a<br \/>\n\tdeclaration under Section 6 of the Act was made which was published<br \/>\n\tin the official gazette on June 29, 2002. The interested persons<br \/>\n\twere thereafter served with notices under Section 9 of the Act for<br \/>\n\tdetermination of amount of compensation payable to them. The<br \/>\n\tclaimants appeared before the Special Land Acquisition Officer and<br \/>\n\tclaimed compensation at the rate of Rs.200\/- per sq.mt. However,<br \/>\n\thaving regard to the materials placed before him, the Special Land<br \/>\n\tAcquisition Officer, by his award dated November 21, 2003, offered<br \/>\n\tcompensation to the claimants at  the rate of Rs.4.50 ps. per sq.mt.<br \/>\n\t The claimants were of the opinion that the offer of compensation<br \/>\n\tmade by the Special Land Acquisition Officer was highly inadequate.<br \/>\n\tTherefore, they filed applications under Section 18 of the Act<br \/>\n\trequiring the Special Land Acquisition Officer to refer the matters<br \/>\n\tto the Court for the purpose of determination of just amount of<br \/>\n\tcompensation payable to them. Accordingly, References were made to<br \/>\n\tthe District Court, Patan, where they were numbered as referred to<br \/>\n\tabove.\n<\/p>\n<p>\tOn<br \/>\n\tbehalf of the claimants, witness Mr.Ramsinh Sumersinh Darbar was<br \/>\n\texamined at Ex.19. Over and above stating that the lands acquired<br \/>\n\twere highly fertile and that each claimant was earning the net<br \/>\n\tincome of Rs.45,000\/- to Rs.55,000\/- per Vigha per year from the<br \/>\n\tsale of agricultural produces, the witness produced previous award<br \/>\n\tof the Reference Court relating to the lands of village Modhera at<br \/>\n\tEx.17 in support of the claim of the claimants for enhanced<br \/>\n\tcompensation. The witness also produced the previous award of the<br \/>\n\tReference Court relating to the lands of village Chandroda at Ex.18<br \/>\n\tin support of the claim for enhanced compensation. Further, the<br \/>\n\twitness produced the sale-deeds relating to the lands of village<br \/>\n\tHarij vide Ex.36 to 38 to support the claim for enhanced<br \/>\n\tcompensation.\n<\/p>\n<p>\tOn<br \/>\n\tbehalf of the appellants, witness Mr.Bhaleshkumar Alkhabhai Asari,<br \/>\n\twho was the Land Acquisition Officer, was examined at Ex.23 whereas<br \/>\n\tMr.Yogendrakumar Jawaharlal Gupta, who was the Deputy Executive<br \/>\n\tEngineer, was examined at Ex.31. Mr.Yogendrakumar Jawaharlal Gupta<br \/>\n\tproduced the previous award of the Reference Court relating to the<br \/>\n\tlands of village Roda for the purpose of consideration of the Court.\n<\/p>\n<p>\tOn<br \/>\n\tappreciation of evidence adduced by the parties, the Reference Court<br \/>\n\twas of the opinion that the previous awards as well as the<br \/>\n\tsale-deeds produced by the parties were relevant for the purpose of<br \/>\n\tdetermining the market value of the lands acquired in the instant<br \/>\n\tcase from village Vansa. On the basis of documents produced by th<br \/>\n\tparties, the Reference Court has awarded additional amount of<br \/>\n\tcompensation to the claimants at the rate of Rs.45\/- per sq.mt. by<br \/>\n\tthe impugned award giving rise to the above numbered Appeals.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has heard Ms.Krina P.Calla with Ms.Tanuja Kachchhi, learned<br \/>\n\tAssistant Government Pleaders, for the appellants as well as<br \/>\n\tMr.Ashok V.Prajapati, learned counsel appearing for the claimant\/<br \/>\n\tclaimants in each Appeal, at great length and in detail. This Court<br \/>\n\thas also considered the documentary evidence as well as oral<br \/>\n\tevidence adduced by the parties before the Reference Court.\n<\/p>\n<p>\tFrom<br \/>\n\tthe record of the case, it is evident that the claimants had relied<br \/>\n\tupon the previous awards of the Reference Court relating to the<br \/>\n\tlands of village Modhera and village Chandroda, which were produced<br \/>\n\tat Exs.17 and 18 respectively. The testimony of witness Mr.Ramsinh<br \/>\n\tSumersinh Darbar recorded at Ex.19 would indicate that no reliable<br \/>\n\tand satisfactory evidence could be adduced to establish that the<br \/>\n\tlands of village Modhera and lands of village Chandroda, which were<br \/>\n\tacquired earlier, were similar in all respects to the lands acquired<br \/>\n\tin the instant case. Further, the testimony of witness<br \/>\n\tMr.Yogendrakumar Jawaharlal Gupta, examined on behalf of the<br \/>\n\tappellants, would indicate that the lands which were previously<br \/>\n\tacquired from village Modhera were situated at a distance of about<br \/>\n\t40 kms. away from the lands acquired from village Vansa whereas the<br \/>\n\tlands of village Chandroda which were previously acquired by the<br \/>\n\tGovernment were situated at a distance of about 20 kms. away from<br \/>\n\tthe lands acquired from village Vansa. In view of great distance at<br \/>\n\twhich the lands acquired in the instant case were situated from the<br \/>\n\tlands of village Modhera and village Chandroda, this Court is of the<br \/>\n\topinion that the previous awards relating to the lands of village<br \/>\n\tModhera and village Chandroda could not have been made basis for the<br \/>\n\tpurpose of determining the market value of the lands acquired in the<br \/>\n\tinstant case.\n<\/p>\n<p>\tFurther,<br \/>\n\tthe cross examination of the witness for the claimants would<br \/>\n\tindicate that agricultural operations were dependent upon rainy<br \/>\n\twaters and rainy season was completely irregular. The record further<br \/>\n\tshows that the lands acquired from village Vansa were situated near<br \/>\n\tdesert of Kutchh and therefore, the claim made by witness Mr.Ramsinh<br \/>\n\tSumersinh Darbar, that the lands acquired were highly fertile and<br \/>\n\tthat each claimant was earning Rs.45,000\/- to Rs.55,000\/- per Vigha<br \/>\n\tper year from the sale of agricultural produces, becomes highly<br \/>\n\tdoubtful.\n<\/p>\n<p>\tAs<br \/>\n\tthe lands acquired from village Vansa were not comparable to the<br \/>\n\tlands which were previously acquired from village Modhera and<br \/>\n\tvillage Chandroda, this Court is of the opinion that the Reference<br \/>\n\tCourt was not justified in placing reliance on those awards for the<br \/>\n\tpurpose  of determining the market value of the lands acquired from<br \/>\n\tvillage Vansa. Similarly, the sale-deeds produced by the witness for<br \/>\n\tthe claimants relating to the lands of village Harij could not have<br \/>\n\tbeen taken into consideration for the purpose of determining the<br \/>\n\tmarket value of the lands acquired from village Vansa for the simple<br \/>\n\treason that they were relating to non-agricultural lands whereas in<br \/>\n\tthe instant case, agricultural lands were acquired. Further, those<br \/>\n\tsale-deeds related to small areas of land compared to the vast area<br \/>\n\tacquired in the instant case. Therefore, this Court is of the firm<br \/>\n\topinion that the Reference Court was also not justified in placing<br \/>\n\treliance on the sale-deeds relating to the lands of village Harij<br \/>\n\tfor the purpose of determining the market value of the lands<br \/>\n\tacquired from village Vansa.\n<\/p>\n<p>\tOnce,<br \/>\n\tthe two previous awards relied upon by the claimants and the<br \/>\n\tsale-deeds relating to the lands of village Harij are taken out of<br \/>\n\tconsideration, the Court is left with the previous award of village<br \/>\n\tRoda for the purpose of determining the market value of the lands<br \/>\n\tacquired in the instant case. It may be mentioned that the previous<br \/>\n\taward of the Reference Court relating to the lands of village Roda<br \/>\n\tis relied upon by the appellants themselves and it is the case of<br \/>\n\tthe appellants that the market value of the lands acquired in the<br \/>\n\tinstant case should be determined on the basis of said previous<br \/>\n\taward. Therefore, the said previous award will have to be taken into<br \/>\n\tconsideration for the purpose of determining the market value of the<br \/>\n\tlands acquired in the instant case.\n<\/p>\n<p>\tThe<br \/>\n\tprevious award of the Reference Court relating to the lands of<br \/>\n\tvillage Roda is produced at Ex.32. It indicates that the lands of<br \/>\n\tvillage Roda, Taluka: Harij, District: Mehsana, were acquired for<br \/>\n\tpublic purpose of Dharoi Canal Project pursuant to publication of<br \/>\n\tNotification issued under Section 4(1) of the Act in the official<br \/>\n\tgazette on January 4, 1993. Therein, the Special Land Acquisition<br \/>\n\tOfficer had awarded compensation to the claimants at the rate of<br \/>\n\tRs.1.95 ps. per sq.mt. though the claim of the claimants was for<br \/>\n\tRs.30\/- per sq.mt. Therefore, the claimants had sought References.<br \/>\n\tAccordingly, References were made to the District Court, Mehsana,<br \/>\n\twhere they were registered as Land Acquisition Reference<br \/>\n\tNos.2586\/1996 to 2602\/1996. The Reference Court, by judgment and<br \/>\n\taward dated August 27, 2001, awarded additional amount of<br \/>\n\tcompensation to the claimants at the rate of Rs.16\/- per sq.mt.<br \/>\n\tDuring the course of hearing of the Appeals, Ms.Krina P.Calla,<br \/>\n\tlearned Assistant Government Pleader, has produced xerox copy of<br \/>\n\tjudgment of the High Court dated April 1, 2005, delivered by the<br \/>\n\tDivision Bench in First Appeals No.3216\/2004 to 3226\/2004 with First<br \/>\n\tAppeals No.845\/2005 to 850\/2005, for perusal of the Court. It<br \/>\n\tindicates that the award of the Reference Court rendered in Land<br \/>\n\tAcquisition Reference Nos.2586\/1996 to 2602\/1996 was challenged by<br \/>\n\tthe Special Land Acquisition Officer before the High Court and the<br \/>\n\tHigh Court, by its judgement dated April 1, 2005, reduced the amount<br \/>\n\tof compensation payable to the claimants of village Roda to Rs.12\/-<br \/>\n\tin all. Thus, on the basis of the previous award of the Reference<br \/>\n\tCourt, as modified by the High Court, relating to the lands of<br \/>\n\tvillage Roda, this Court is of the opinion that the claimants in the<br \/>\n\tinstant case would be entitled to compensation at the rate of<br \/>\n\tRs.12\/- per sq.mt.\n<\/p>\n<p>\tThe<br \/>\n\trecord further shows that Notification under Section 4(1) of the Act<br \/>\n\tfor acquiring the lands of village Roda was published in the<br \/>\n\tofficial gazette on January 4, 1993, whereas in the instant case,<br \/>\n\tNotification for acquiring the lands of village Vansa was published<br \/>\n\tin the official gazette on April 5, 2002. Thus, there is no manner<br \/>\n\tof doubt that there was a gap of about ten years between publication<br \/>\n\tof Notifications issued under Section 4(1) of the Act for acquiring<br \/>\n\tthe lands from the two villages. The Supreme Court has laid down in<br \/>\n\tcatena of reported decisions that if there is time gap between<br \/>\n\tpublication of Notifications issued under Section 4(1) of the Act,<br \/>\n\tthe claimant would be entitled to reasonable rise in price of lands<br \/>\n\tat the rate of 10% p.a. If rise in price at the rate of 10% p.a. is<br \/>\n\tgranted to the claimants in the instant case, this Court is of the<br \/>\n\topinion that the claimants would be entitled to compensation at the<br \/>\n\trate of Rs.24\/- per sq.mt. in all. The above discussion would<br \/>\n\tindicate that the claimants are entitled to compensation at the rate<br \/>\n\tof Rs.24\/- per sq.mt. in all and not at the rate of Rs.49.50 ps. per<br \/>\n\tsq.mt. as held by the Reference Court. The Appeals filed by the<br \/>\n\tState Government will have to be accordingly allowed.\n<\/p>\n<p>\tFor<br \/>\n\tthe foregoing reasons, the Appeals partly succeed. The common<br \/>\n\tjudgment and award dated July 1, 2005, rendered by the learned Joint<br \/>\n\tDistrict Judge, 3rd Fast Track Court, Patan, in Land<br \/>\n\tAcquisition Reference Case No.13\/2004 to 22\/2004, awarding<br \/>\n\tcompensation to the claimants at the rate of Rs.49.50 per sq.mt. in<br \/>\n\tall is hereby modified and it is held that the claimants would be<br \/>\n\tentitled to compensation in all at the rate of Rs.24\/- per sq.mt.<br \/>\n\tfor their acquired lands. The other benefits granted by the impugned<br \/>\n\taward are not interfered with at all and are hereby confirmed. The<br \/>\n\tAppeals are accordingly partly allowed. There shall be no orders as<br \/>\n\tto costs.
