(J)\n\nCITATION:\n 1995 SCC  (6)\t86\t  JT 1995 (7)\t 85\n 1995 SCALE  (5)467\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Pursuant to  the  notice  under  s.10(2)  of  the\tU.P.<br \/>\nImposition of Coiling on Land Holdings Act, 1960 [for short,<br \/>\n`the Act&#8217;],  the appellant had submitted his return. Therein<br \/>\nhe had\tstated that  on May  6, 1965,  he had  gifted  under<br \/>\nKhasra No.266  eighteen biswas\t`Pukhta&#8217;, under\t No.613\t two<br \/>\nbighas, seven  biswas and  ten biswansis; under No.616 three<br \/>\nbighas, sixteen\t biswas and  six biswansis etc. etc. All the<br \/>\nauthorities concurrently  found that  the  gift\t is  a\tsham<br \/>\ntransaction to\tavoid the  ceiling imposed  under s.5 of the<br \/>\nAct. The  High Court  in its  order dated 10.11.1978 made in<br \/>\nC.M.W.P. No.522\/78  dismissed the petition agreeing with the<br \/>\nfinding thus:\n<\/p>\n<blockquote><p>     &#8220;In my  view, the\tPrescribed  Authority<br \/>\n     and the  Court below  which affirmed the<br \/>\n     decision of  the Prescribed Authority on<br \/>\n     the controversy  have recorded  findings<br \/>\n     which cannot  be said  to be vitiated by<br \/>\n     any  jurisdictional   error.  They\t were<br \/>\n     entitled to  reach their  own conclusion<br \/>\n     and this  court in its writ jurisdiction<br \/>\n     cannot substitute\tits own\t judgment for<br \/>\n     the decision of the Prescribed Authority<br \/>\n     on the  ground that the said decision or<br \/>\n     the  judgment  of\tthe  lower  appellate<br \/>\n     court should not have been so pronounced<br \/>\n     on the basis of material and evidence on<br \/>\n     the record.  The next  point  urged  was<br \/>\n     that plot no.992 is Abadi land. Again, I<br \/>\n     find that\tthe necessary  discussion  is<br \/>\n     there in  the order  of  the  Prescribed<br \/>\n     Authority and  in the  judgment  of  the<br \/>\n     lower appellate  court and\t a finding of<br \/>\n     fact has  been recorded  which cannot be<br \/>\n     disturbed in the writ jurisdiction.&#8221;<\/p><\/blockquote>\n<p>     Mr. Ravindra  Bana, learned  counsel for the appellant,<br \/>\ncontanded that\tin view\t of the\t decision of  this Court  in<br \/>\nRamadhar Singh\tvs. Prescribed\tAuthority  and\tOrs.,[(1994)<br \/>\nSupp.3 SCC  702], the land covered by the gift deed needs to<br \/>\nbe excluded  by operation  of s.5(6)  of the  Act. Mr.\tR.C.<br \/>\nVerma, learned\tcounsel appearing  for the  State urged that<br \/>\ninitially the notified date which the statute had prescribed<br \/>\nwas August  20, 1959.  Since the appellant had not submitted<br \/>\nhis return  for computation  of the  surplus  ceiling  area,<br \/>\nnotice under  s.10 (2)\tcame to\t be issued.  Therein, he had<br \/>\ncome with the plea that he had gifted the land to his grand-<br \/>\nnephew. Since  the court below and the High Court had found,<br \/>\nas a  fact, that  the transaction of gift was a sham one, it<br \/>\nmust be\t construed as  if there was no alienation or that it<br \/>\nwas intended to defeat the provisions of the Act. Therefore,<br \/>\nthe Amendment Act cannot be applied in the circumstances. In<br \/>\nthat view,  the ratio  of Ramdhar  Singh&#8217;s case (supra) does<br \/>\nnot apply to the facts in this case.\n<\/p>\n<p>     The question for consideration is whether the appellant<br \/>\nis entitled  to have  the lands\t covered under the gift deed<br \/>\nexcluded from  his holdings. If the gift deed is accepted to<br \/>\nbe valid  one, his holding would be within the ceiling limit<br \/>\nprescribed by Section 5 of the Act. But Section 5 of the Act<br \/>\npostulates that\t on and from the date of its enforcement, no<br \/>\ntenure-holder shall,  except as\t otherwise provided  by this<br \/>\nAct, be\t entitled to  hold an  area in excess of the ceiling<br \/>\narea applicable\t to him,  notwithstanding anything contained<br \/>\nin any\tother law,  custom or  usage for  the time  being in<br \/>\nforce, or  agreement, to  the contrary.\t In determining\t the<br \/>\nceiling\t area\tapplicable  to\t a  tenure-holder   at\t the<br \/>\ncommencement of\t this Act  any transfer or partition of land<br \/>\nmade after the twentieth day of August, 1959, which, but for<br \/>\nthe transfer  or partition  would have been declared surplus<br \/>\nland under  the provisions of this Act, shall be ignored and<br \/>\nnot taken into account. It would thus be clear that when the<br \/>\nAct had\t come into  force and  declared that any transfer or<br \/>\npartition effected  on or after the twentieth day of August,<br \/>\n1959 shall  be ignored\tand shall not be taken into account,<br \/>\nthe statutory  provision required that the excess land shall<br \/>\nbe computed  as if  the land  held by  the declarant  on  or<br \/>\nbefore the twentieth day of August, 1959 was not affected by<br \/>\nvirtue of any transfer or partition effected thereafter, and<br \/>\nsurplus shall be computed, despite such transfer. In view of<br \/>\nthe finding  recorded by the courts below that the gift deed<br \/>\nwas a  sham document  in law, it does not have any existence<br \/>\nwhich binds the Government in determining the surplus area.\n<\/p>\n<p>     In view  of the finding that it is a sham document, the<br \/>\nvalidation of any transfer or partition effected on or after<br \/>\nJanuary 24,  1971 is of no avail to the appellant. The ratio<br \/>\nin the\tabove case  has no  application to  the facts of the<br \/>\ncase. The appeal is accordingly dismissed.
