    This petition is filed under section 482 of<\/p>\n
the Code of Criminal Procedure by the accused<\/p>\n
in  Crime  645\/2010  of  Pathanamthitta  Police<\/p>\n
Station  registered   for  the  offence   under<\/p>\n
section 408 of Indian Penal Code on Annexure 2<\/p>\n
F.I.R.  The case of the petitioner is that the<\/p>\n
case is registered based on the information<\/p>\n
furnished by a third party, who has no personal<\/p>\n
information and hence  has no locus standi. It<\/p>\n
is  also  contended  that  as  the  offence  is<\/p>\n
alleged to have committed outside India without<\/p>\n
the previous sanction of the Central Government<\/p>\n
as  provided  under  section  188  of  Code  of<\/p>\n
Criminal  Procedure,   the   case   cannot   be<\/p>\n
registered or investigated.\n<\/p>\n
    2.    Learned  counsel  appearing  for  the<\/p>\n
Crl.M.C.2565\/2010             2<\/span><\/p>\n
petitioner and the learned Public Prosecutor were<\/p>\n
heard.\n<\/p>\n
      3.        The argument  of  the  learned  counsel<\/p>\n
appearing for the petitioner is that the first<\/p>\n
informant has no direct knowledge with regard to<\/p>\n
the allegations raised therein and therefore he has<\/p>\n
no locus standi to file a complaint and based on<\/p>\n
such complaint, no case can be registered.       It is<\/p>\n
also argued that in any case the case can be<\/p>\n
investigated only by the Central Government and not<\/p>\n
by the State Government.          Learned counsel also<\/p>\n
argued       that   when  admittedly no  sanction   was<\/p>\n
obtained        from     the  Central  Government,   no<\/p>\n
investigation could be conducted.       Learned counsel<\/p>\n
argued that in view of Section 34A of Extradition<\/p>\n
Act, subsequent to the amended Section 188 of Code<\/p>\n
of Criminal Procedure, the case could be registered<\/p>\n
only as provided under 34A of Extradition Act.<\/p>\n
      4. Learned counsel appearing for the Central<\/p>\n
Government submitted that under Annexure 2 the case<\/p>\n
has     been     registered  based  on  the   statement<\/p>\n
Crl.M.C.2565\/2010            3<\/span><\/p>\n
forwarded and by that statement law has only been<\/p>\n
set in        motion and being a cognizable offence the<\/p>\n
case can be registered and investigated.         It is<\/p>\n
also submitted that the sanction is necessary only<\/p>\n
for taking cognizance of the offence and not for<\/p>\n
investigation.\n<\/p>\n
      5.       I  cannot agree  with  argument  of  the<\/p>\n
learned counsel appearing for the petitioner that<\/p>\n
previous sanction of the Central Government is<\/p>\n
necessary to register a case or to investigate the<\/p>\n
case.      Section 188 of Code of Criminal Procedure<\/p>\n
provides       for  investigation of   cases  committed<\/p>\n
outside India.       Under the  section when an offence<\/p>\n
is committed outside India by a citizen of India,<\/p>\n
whether on the high seas or elsewhere or by a<\/p>\n
person, not being such citizen, on any ship or<\/p>\n
aircraft registered in India, he may be dealt with<\/p>\n
in respect of such offence as if it had been<\/p>\n
committed at any place within India at which he may<\/p>\n
be      found.         The   proviso   mandates    that<\/p>\n
notwithstanding anything in any of the preceding<\/p>\n

sections of Chapter XIII, no such offence shall be<\/p>\n
inquired into or tried in India except with the<\/p>\n
previous       sanction   of  the  Central   Government.<\/p>\n
Therefore previous sanction of Central Government<\/p>\n
is necessary only for any        “inquiry or trial” and<\/p>\n
not for investigation as held by the Full Bench of<\/p>\n
this     Court    in   Samaruddin  v.  Asst.Director  of<\/p>\n
Enforcement (1999(3) ILR 333).         Section 188 does<\/p>\n
not provide that such a case is to be investigated<\/p>\n
by the Central Government as canvassed by learned<\/p>\n
counsel.        The  police is competent to investigate<\/p>\n
the case.        I find no no merit in the petition.  It<\/p>\n
is dismissed.\n<\/p>\n<\/p>\n
