Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a  Writ  of  Habeas  Corpus to call for the records of the first\nrespondent herein concerned in  Cr.M.P.No.54\/2005,  set  aside  the  order  of\ndetention  passed  therein  dated 14.09.2005 against the detenu and direct the\nrespondents to produce the detenu by name Barathiraja S\/  o  Raju  Kaduvettiar\nbefore the Court and set him at liberty, detained in Central Prison, Trichi.\n\n!For Petitioner         :  Mr.K.Manivasakam\n\n^For Respondents        :  Mr.M.K.Subramanian\n                Govt. Side)\n\n:O R D E R \n<\/pre>\n<p>(Order of the Court was made by P.SATHASIVAM, J.)   <\/p>\n<p>        The  petitioner  is  the mother of the detenu by name Barathiraja, who<br \/>\nwas detained as &#8216;Bootlegger&#8217; as contemplated under the Tamil  Nadu  Prevention<br \/>\nof  Dangerous  Activities  of  Bootleggers,  Drug Offenders, Forest Offenders,<br \/>\nGoondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act,  1982<br \/>\n(Tamil Nadu Act 14 of 1982), by the impugned detention order dated 14.09.2005,<br \/>\nchallenges the same in this Petition.\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is unexplained delay in  the  disposal  of  the  representation  of  the<br \/>\ndetenu, which  vitiates  the  ultimate order of detention.  With regard to the<br \/>\nabove contention, learned Government  Advocate  has  placed  certain  details,<br \/>\nwhich show that the representation of the detenu dated 22.09.2005 was received<br \/>\nby  the  Government on 27.09.2005 and remarks were called for on the same date<br \/>\ni.e.  on 27.09.2005 and remarks were received by the Government on 10.10.2005.<br \/>\nThereafter, the file was submitted on the same date i.e.   on  10.10.2005  and<br \/>\nthe  same  was  dealt  with  by  the  Under  Secretary and Deputy Secretary on<br \/>\n13.10.2005 and finally, the Minister for Prohibition and Excise passed  orders<br \/>\non 1  4.10.2005.  The rejection letter was prepared on 20.10.2005 and the same<br \/>\nwas sent to the detenu on 21.10.2005 and served to him on  24.10  .2005.    As<br \/>\nrightly  pointed  out  by  the  learned counsel for the petitioner, though the<br \/>\nMinister for Prohibition and Excise passed an order on 14.10.2005, there is no<br \/>\nexplanation at all for taking time for preparation of  rejection  letter  till<br \/>\n20.10.2005.   In  the  absence of any explanation by the person concerned even<br \/>\nafter excluding the intervening holidays, we are of the  view  that  the  time<br \/>\ntaken  for  preparation  of rejection letter is on the higher side and we hold<br \/>\nthat  the  said  delay  has  prejudiced  the  detenu  in   disposal   of   his<br \/>\nrepresentation.  On this ground, we quash the impugned order of detention.\n<\/p>\n<p>        4.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from custody unless he is required in  some  other  case  or<br \/>\ncause.\n<\/p>\n<p>raa<\/p>\n<p>To<\/p>\n<p>1.The District Magistrate and District collector, Tiruchirappalli District,<br \/>\nTiruchirappalli.\n<\/p>\n<p>2.
