{"id":142938,"date":"2009-01-19T00:00:00","date_gmt":"2009-01-18T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/nathu-deen-vs-bashir-ahmed-and-another-on-19-january-2009"},"modified":"2016-12-27T00:34:14","modified_gmt":"2016-12-26T19:04:14","slug":"nathu-deen-vs-bashir-ahmed-and-another-on-19-january-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/nathu-deen-vs-bashir-ahmed-and-another-on-19-january-2009","title":{"rendered":"Nathu Deen vs Bashir Ahmed And Another on 19 January, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Nathu Deen vs Bashir Ahmed And Another on 19 January, 2009<\/div>\n<pre>      IN THE HIGH COURT OF PUNJAB AND HARYANA AT\n                     CHANDIGARH.\n\n\n                                                            CR NO.267\/2009\n                                                   Date of Decision:19.1.2009.\n\nNathu Deen\n                                       ..........Petitioner.\n\n               Versus\n\nBashir Ahmed and another.\n                                    ..........Respondents.<\/pre>\n<pre>CORAM:         HON'BLE MR.JUSTICE JASWANT SINGH.\n\nPresent:-      Mr.Ravinder Malik(Ravi)Advocate for the petitioner-\n               defendant no.2.\n\n\nJASWANT SINGH,J(Oral).\n\n<\/pre>\n<p>               The petitioner-defendant no.2 has filed this revision petition<\/p>\n<p>under Article 227 of the Constitution of India, praying for setting aside the<\/p>\n<p>order dated 3.4.2008 (Annexure P\/1) passed by learned Additional Civil<\/p>\n<p>Judge (Senior Division) Jagadhari, whereby the defence of petitioner has<\/p>\n<p>been ordered to be struck off on account of non-filing of written statement<\/p>\n<p>and reply to the application under Order 39 Rules 1 and 2 CPC, despite last<\/p>\n<p>opportunity.\n<\/p>\n<p>               It is stated that respondent no.1 Bashir Ahmed filed a suit for<\/p>\n<p>possession regarding land measuring 8 marlas, allegedly in unauthorised<\/p>\n<p>possession of the petitioner-defendant no.2 and for recovery of mesne<\/p>\n<p>profits with a further prayer for decree of permanent injunction. The suit<\/p>\n<p>was filed on 12.12.2007. It is submitted that petitioner-defendant no.2 is<\/p>\n<p>semi-literate aged man of about 70 years and was unable to produce\/submit<\/p>\n<p>the necessary documents, required for preparation of the written statement,<br \/>\n<span class=\"hidden_text\"> CR NO.267\/2009                                          2<\/span><\/p>\n<p>to his counsel.    It is further pointed out that    after the passing of the<\/p>\n<p>impugned order dated 3.4.2008 (Annexure P\/1), petitioner-defendant no.2<\/p>\n<p>had filed an application for recalling of the said order which has been<\/p>\n<p>dismissed vide order dated 5.12.2008 (Annexure P\/2), as being not<\/p>\n<p>maintainable.\n<\/p>\n<p>             Learned counsel prays for one last opportunity for filing written<\/p>\n<p>statement, which is necessary for effective adjudication of the case.<\/p>\n<p>             As far as the period prescribed for filing the written statement<\/p>\n<p>under Order 8 Rule 1 CPC, is concerned, the same has been held to be<\/p>\n<p>directory in nature by judgments of Hon&#8217;ble the Supreme Court in Kailash<\/p>\n<p>v.Nankhu and others, 2005(2)RCR (Civil) 379(SC); and <a href=\"\/doc\/1461813\/\">M\/s R.N.Jadi &amp;<\/p>\n<p>Brothers and others v. Subhashchandra,<\/a> 2007(2)RCR (Rent) 139: 2007<\/p>\n<p>(3) RCR (Civil) 588: 2007(4) Raj 125 (SC);            and    of this Court in<\/p>\n<p><a href=\"\/doc\/1507404\/\">Surender Singh and others v. Omvati and others<\/a>, 2005(3) RCR (Civil)<\/p>\n<p>786 (P&amp;H).        It has further been held therein        that in exceptional<\/p>\n<p>circumstances the Court can extend time beyond 90 days for filing written<\/p>\n<p>statement so as to avoid injustice being caused to the parties.<\/p>\n<p>             After hearing the learned counsel for the petitioner-defendant<\/p>\n<p>no.2, and keeping in view the aforesaid legal principles, this Court is of the<\/p>\n<p>view that the petitioner on account of reasons given in the petition for non-<\/p>\n<p>filing of the written statement in time, is entitled to one more opportunity<\/p>\n<p>for filing his written statement, as no prejudice is going to be caused to the<\/p>\n<p>other side. Furthermore, keeping in view the nature of the suit, filing of the<\/p>\n<p>written statement would be essential for proper adjudication. It is quite<br \/>\n<span class=\"hidden_text\"> CR NO.267\/2009                                         3<\/span><\/p>\n<p>settled that the approach of the Courts should be towards final and<\/p>\n<p>substantial determination of disputes between the parties, rather than<\/p>\n<p>defeating them on hypertechnical grounds.\n<\/p>\n<p>             Accordingly, this revision petition is allowed. The impugned<\/p>\n<p>order dated 3.4.2008 (Annexure P\/1) is set aside and the petitioner-<\/p>\n<p>defendant no.1 is granted one last opportunity to file his written statement,<\/p>\n<p>within 15 days from the date of receipt of a copy of this order, subject to<\/p>\n<p>payment of Rs.3000\/- as costs to be paid to the plaintiff-respondent no.1.<\/p>\n<pre>\n\n\n\n\n19.1.2009.
