It was sought to be asserted that the aforesaid amount<br \/>\n\twas rightly deducted and withheld by the respondent &#8211; bank.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tcounsel on both sides and there being a limited consensus arrived at<br \/>\n\tduring the course of arguments, it is not relevant or necessary to<br \/>\n\trelate the factual matrix in which dispute about the aforesaid<br \/>\n\tamount had arisen. It was proposed by learned senior advocate,<br \/>\n\tMr.S.B.Vakil, appearing for the appellant that without claiming at<br \/>\n\tthis stage reversal of the order by which the aforesaid amount was<br \/>\n\tdeducted from the account of the appellant, and without inviting any<br \/>\n\tshow-cause notice, the appellant would make a clear and concise<br \/>\n\trepresentation before respondent No.1 and it may be decided within a<br \/>\n\treasonable period for satisfactory resolution of the dispute within<br \/>\n\tthe bank itself. As against that, learned counsel, Dr.Mahesh Thakar,<br \/>\n\tfairly conceded that the respondent had not sought any proceeding<br \/>\n\tagainst the advocate who held the power of attorney of the<br \/>\n\tappellant, and without prejudice to the rights and contentions of<br \/>\n\tthe respondent, they would have no objection to deciding such<br \/>\n\trepresentation as may be made by the appellant, in respect of the<br \/>\n\tdisputed amount. He fairly stated that if the amount in dispute were<br \/>\n\trequired to be paid in accordance with law and the rules applicable<br \/>\n\tto the bank, and the proposed representation of the appellant is<br \/>\n\tdecided in favour of the appellant, there will not be any further<br \/>\n\tunnecessary round of litigation. Similarly, if the decision on the<br \/>\n\tproposed representation goes against the appellant, but contains<br \/>\n\tvalid and sufficient reasons, the appellant would have no occasion<br \/>\n\tto carry the matter further.\n<\/p>\n<p>\tThus, admittedly, the<br \/>\n\tparties having adopted the better method of resolving the dispute<br \/>\n\tamong them, the impugned order would come in their way and,<br \/>\n\ttherefore, required to be set-aside by consent and without entering<br \/>\n\tinto merits or the rights and contentions of the parties.<br \/>\n\tAccordingly, the appeal is allowed, the impugned order dated<br \/>\n\t11.5.2010 in Special Civil Application No.5873 of 2010 is set-aside<br \/>\n\tby consent, and in terms of the consensus, the appellant is directed<br \/>\n\tto make his representation either by himself or through his power of<br \/>\n\tattorney to respondent No.1, who shall decide such representation<br \/>\n\twithin a period of one month after receipt thereof and communicate<br \/>\n\tthe decision by RPAD to the appellant.
