      Appellant is stated to be the proprietor of M\/s.<\/p>\n
Niravath Industries, a wood based industrial unit, at<\/p>\n
Kattappana Mini Industrial Estate.\n<\/p>\n
      2. The specific case of the appellant is that he has<\/p>\n
been conducting the above industrial unit and sawmill<\/p>\n
attached thereto ever since 1979, after obtaining requisite<\/p>\n
licence, permit etc. from the authorities concerned.<\/p>\n
According to him, Ext.P11 notice issued by the Range<\/p>\n
Officer, Ayyappancoil way back in January 1999 will<\/p>\n
substantiate and fortify his case that the sawmill has been<\/p>\n
in existence for the last several years.<\/p>\n
      3. Any how we do not propose to refer to the various<\/p>\n
road blocks that the appellant faced during the last few<\/p>\n
years and also to the several rounds of litigation that<\/p>\n
followed, in view of the order that we propose to pass.<\/p>\n

       4. It is on record that by Ext.P2 judgment dated<\/p>\n
December 16,2005 in O.P. No.3427 of 1999 a learned Single<\/p>\n
Judge of this Court quashed the order of Forest Department<\/p>\n
directing the appellant to close down the sawmill. However<\/p>\n
it was made clear that the Forest Department would be at<\/p>\n
liberty to take action against the appellant in case he was<\/p>\n
involved in any forest offence.\n<\/p>\n
       5. It is beyond controversy that by order dated<\/p>\n
December 14, 2009 the Divisional Forest Officer, Kottayam<\/p>\n
cancelled the No Objection Certificate issued in favour of<\/p>\n
the appellant to run a sawmill on the ground that it had<\/p>\n
been issued “erroneous ly and inadvertently” relying on a<\/p>\n
certificate issued by the Panchayat.\n<\/p>\n
       6. The above order (Ext.P3) was challenged before<\/p>\n
this Court in a writ petition under Article 226 of the<\/p>\n
Constitution of India. A learned Single Judge dismissed the<\/p>\n
writ petition, against which the appellant preferred W.A.<\/p>\n
No.135 of 2010. A Division Bench of this Court, by judgment<\/p>\n
dated January 27, 2010 relegated the appellant to the State<\/p>\n
Level Committee for wood based industries in Kerala to<\/p>\n

work out his remedies. It was however directed that status<\/p>\n
quo as on the date of the judgment shall be maintained till<\/p>\n
orders were passed by the committee on the interim<\/p>\n
application that may be filed by the appellant.<\/p>\n
       7. It is seen from the records that the appellant had<\/p>\n
filed an application for grant of No Objection Certificate<\/p>\n
before the State Level Committee as early as on December<\/p>\n
31, 2009. An interlocutory application was also filed by the<\/p>\n
appellant seeking permission to continue to operate the unit<\/p>\n
and sawmill. However, the committee rejected the prayer<\/p>\n
for interim relief by its order dated August 20, 2010, a copy<\/p>\n
of which is on record as Ext.P17.\n<\/p>\n
       8. The said interim order passed by the committee<\/p>\n
was challenged by the appellant before the learned Single<\/p>\n
Judge, who by the impugned judgment held that the<\/p>\n
decision taken by the Committee did not appear to be<\/p>\n
faulty, warranting any interference. But it was observed by<\/p>\n
the learned Single Judge that if the appellant possessed the<\/p>\n
requisite licence to run the furniture unit, it would be open<\/p>\n
to him to approach the Divisional Forest Officer, Kottayam<\/p>\n

to allow him to operate the same and the officer was<\/p>\n
directed to pass appropriate orders on such request in<\/p>\n
accordance with law. The above judgment passed by the<\/p>\n
learned Single Judge is impugned in this appeal .<\/p>\n
       9. We have heard Sri. George Poonthottam learned<\/p>\n
counsel for the appellant and Sri. P.M. Poulose learned<\/p>\n
Special Government Pleader (Forest). We have perused the<\/p>\n
materials available on record.\n<\/p>\n
       10.     Having  regard  to   the   entire   facts  and<\/p>\n
circumstances of the case, we are of the view that it will be<\/p>\n
appropriate at this juncture to direct respondent No.3, the<\/p>\n
State Level Committee to take a final decision on the<\/p>\n
application submitted by the appellant for grant of No<\/p>\n
Objection Certificate, particularly since the said application<\/p>\n
has been pending consideration before the Committee for<\/p>\n
more than one year.\n<\/p>\n
       11. Learned Special Government Pleader submits that<\/p>\n
an appropriate decision in the matter will be taken without<\/p>\n
any further delay.\n<\/p>\n
       12. In that view of the matter, the Committee is<\/p>\n
W.P.(C) No. 1904\/2010         5<\/span><\/p>\n
directed to take a final decision in the matter, as<\/p>\n
expeditiously as possible at any rate within two months<\/p>\n
from the date of receipt of a copy of this judgment. The<\/p>\n
committee shall ensure that the appellant is afforded<\/p>\n
sufficient opportunity to be heard before any orders are<\/p>\n
passed. It will be open to the appellant to produce<\/p>\n
additional documents in support of his case.<\/p>\n
       13. It is made clear that the Committee shall take a<\/p>\n
decision in the matter untrammelled and uninfluenced by<\/p>\n
any of the observations made by the learned Single Judge in<\/p>\n
the impugned judgment. We make it further clear that we<\/p>\n
have not considered the merit or demerit of the case.<\/p>\n
       The appeal is disposed of in the above terms.<\/p>\n
