Similarly,<br \/>\nthe appellants-original accused no.3 was sentenced to suffer R.I. For<br \/>\nfive years and fine of Rs.5000\/-, in default R.I for 3 months in each<br \/>\nof the offence punishable under Sections 489(B) and 489(C) read with<br \/>\nSection 34 of the Indian Penal Code while the appellants-original<br \/>\naccused nos.6 and 7 were acquitted.Both the sentences were ordered to<br \/>\nrun concurrently.\n<\/p>\n<p>1.1\tIn<br \/>\nCriminal Appeal no.1426\/2005, the appellants-original accused nos.1<br \/>\nand 2 challenge their conviction and sentence while in Criminal<br \/>\nAppeal no.1445\/2005, the appellants-original accused nos.4 and 5<br \/>\nchallenge their conviction and sentence.\n<\/p>\n<p>2.\tBrief<br \/>\nfacts of the prosecution case as emerging  from the record of the<br \/>\ntrial Court are as under:\n<\/p>\n<p>2.1\tOn<br \/>\n16-2-2004 a First Information Report was lodged by the Police<br \/>\nInspector Shri K.K.Patel against the present appellants and other<br \/>\naccused persons with the D.C.B. Police Station which was registered<br \/>\nas CR no.I-13 of 2004 for the offences punishable under Sections<br \/>\n489(A),(B) and (C )read with Section 34 of the Indian Penal Code. It<br \/>\nis alleged therein that the present appellants and other accused<br \/>\npersons in collusion with each other were printing fake currency<br \/>\nnotes by using computer and scanner and circulating these currency<br \/>\nnotes which were in the denomination of Rs.1000\/-, Rs.500\/-, Rs.100\/-<br \/>\nand Rs.50\/- in the market. In this manner, the all the<br \/>\nappellants-accused were causing national loss to the exchequer.  In<br \/>\npursuance of the said complaint, the vehicles of these appellants<br \/>\ncame to be intercepted at Rajkot and fake currency notes in the<br \/>\naforesaid denominations amounting Rs.7,50,000\/-were seized in<br \/>\npresence of Panchas  and necessary formalities were carried out. On<br \/>\ncompletion of the investigation charge-sheet was submitted on<br \/>\n12-5-2004. All the appellants-original accused were arrested and<br \/>\ntaken into judicial custody. The case was committed to the Sessions<br \/>\nCourt, Surat and was numbered as Sessions Case no.61 of 2004. The<br \/>\nlearned Presiding Officer, Fast Track Court no.10, Surat, framed<br \/>\ncharge against the appellants-original accused which was read over<br \/>\nand explained to the appellants-original accused. The<br \/>\nappellants-original accused pleaded not guilty to the charge and<br \/>\nclaimed to be tried.\n<\/p>\n<p>3.\tTo<br \/>\nprove its case against the appellants-original accused the<br \/>\nprosecution has examined 17 witnesses and also produced documentary<br \/>\nevidence. After recording the evidence of prosecution witnesses  was<br \/>\nover, the further statement of the appellants-accused under Section<br \/>\n313 of the Criminal Procedure Code came to be recorded in which the<br \/>\ndefence of the accused was of total denial and that they were falsely<br \/>\nimplicated in the case.\n<\/p>\n<p>4.\tOn<br \/>\nappreciation, evaluation, analysis and scrutiny of the evidence<br \/>\nadduced by the prosecution both oral as well as documentary, the<br \/>\nlearned Presiding Officer, Fast Track Court no.10, Surat,passed the<br \/>\njudgment and order of conviction and sentence as stated in para-1 of<br \/>\nthe judgment. Hence, the present appeal.\n<\/p>\n<p>5.\tMention<br \/>\nrequires to be made here that the learned Counsel for the present<br \/>\nappellants-original accused had confined her arguments only on the<br \/>\npoint of reduction in the sentence.\n<\/p>\n<p>6.\tLearned<br \/>\nCounsel Ms. Sadhana Sagar for the present appellants-original accused<br \/>\nsubmitted that the learned trial Judge has erred in awarding sentence<br \/>\nin asmuch as though the learned trial Judge arrived at a specific<br \/>\nfinding that the all the appellants-original accused nos1,2, 3,4, and<br \/>\n5 played  vital and similar role, the sentence awarded to the<br \/>\nappellant-original accused no.3 is lesser than that awarded to the<br \/>\npresent appellants-original accused nos.1,2,4 and 5. According to the<br \/>\nlearned Counsel all the appellants-original accused nos.1,2,3, 4 and<br \/>\n5 were  also convicted for the offence under Sections 489(B) and<br \/>\n489(C) read with Section 34, and therefore, a different yardstick<br \/>\ncannot be applied while awarding the sentence to any of them. She<br \/>\nfurther submitted that in the interest of justice, the present<br \/>\nappellants be also treated at par with the appellant-original accused<br \/>\nno.3 and be awarded a similar sentence.\n<\/p>\n<p>7.\tLearned<br \/>\nA.P.P. Mr. Raval, however, contended that taking into consideration<br \/>\nthe offence committed by each of the appellant-accused, the Court may<br \/>\naward appropriate sentence.\n<\/p>\n<p>8.\tThis<br \/>\nCourt has gone through the entire record of the case including the<br \/>\njudgment and order of conviction and sentence passed by the learned<br \/>\nPresiding Officer, Fast Track Court no.10, Surat, dated 8-8-2005. I<br \/>\nam in complete agreement with the reasonings adopted and the<br \/>\nconclusions arrived at by the learned trial Judge in the impugned<br \/>\njudgment so far as the conviction of the present appellants is<br \/>\nconcerned, however, the sentence part requires modification. The<br \/>\nlearned Judge in para 60 of the judgment held that the<br \/>\nappellants-original accused nos.1,2,3,4 and 5 have played vital role<br \/>\nin furtherance of a common object of printing and circulating fake<br \/>\ncurrency notes, and thereby committed the offences punishable under<br \/>\nSections 489(B) and 489(C) read with Section 34 of the Indian Penal<br \/>\nCode, and therefore held them guilty for these offences. Considering<br \/>\nthe fact that the learned trial Judge has arrived at a specific<br \/>\nfinding that all these accused have played similar role and committed<br \/>\nthe same offence, I am of the considered opinion that both these<br \/>\nappeals deserve to be partly allowed by modifying the sentence only<br \/>\nso as to meet the ends of justice.\n<\/p>\n<p>9.\tIn<br \/>\nthe result, both these appeals<br \/>\nsucceed in part and accordingly, they are partly allowed qua the<br \/>\nsentence only. The judgment and order of conviction dated 15-7-2005<br \/>\nrendered in Sessions Case no.61 of 2004 by the learned Presiding<br \/>\nOfficer, Fast Track Court no.10,Surat in Sessions Case no.61 of 2004<br \/>\nagainst the appellants-original accused nos.1,2, 4 and 5 convicting<br \/>\nthem for the offence under Sections 489(B) and 489(C) read with<br \/>\nSection 34 of the Indian Penal Code is hereby confirmed and<br \/>\nmaintained.\n<\/p>\n<p>\tSo<br \/>\nfar as the sentence is concerned, the appellant-original accused<br \/>\nnos.1,2,4 and 5, each of them, are sentenced to suffer R.I for five<br \/>\nyears and fine of Rs.5000\/-, in default, further R.I. for 3 months<br \/>\nfor each of the offence under Sections 489(B) and 489(C) read with<br \/>\nSection 34 of the Indian Penal Code.\n<\/p>\n<p>\tBoth<br \/>\nthese appeals are accordingly partly allowed as indicated<br \/>\nhereinabove.\n<\/p>\n<p>(M.D.Shah,J.)<\/p>\n<p>lee.\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Sureshbhai vs Appearance on 7 August, 2008 Author: Md Shah,&amp;Nbsp;
