Application No. 3277\/07 but the same was sought to be withdrawn<br \/>\non the ground that as the investigation was still going on there was<br \/>\nlikelihood of more material coming on record which could help the<br \/>\napplicant.  Therefore, the permission as sought for was granted and<br \/>\nthe matter was allowed to be withdrawn by this Court vide order dated<br \/>\n01.05.07.  Now, the supplementary charge-sheet has been filed whereof<br \/>\nthe Choksi committee report is forming part and therefore relying<br \/>\nupon this report, this successive bail application is filed.\n<\/p>\n<p>2.1\tIt<br \/>\ndeserves to be noted that before filing of this application, the<br \/>\napplicant appears to have approached the concerned Sessions Court by<br \/>\npreferring Criminal Misc. Application No. 798\/07 but the same was<br \/>\nrejected by the concerned court vide order dated 10.09.07.\n<\/p>\n<p>3.\tMr<br \/>\nK.B Anandjiwala, learned counsel appearing for the applicant has<br \/>\nsubmitted that the applicant was the Loan Manager of the Bank.  The<br \/>\nloan papers were brought to the applicant and he used to sign those<br \/>\npapers in his capacity as such.  Mr Anandjiwala has sought to rely<br \/>\nupon the FIR filed by a co-accused Shri Jayant Merajbhai Shah wherein<br \/>\nit is stated that he was interested in betting and therefore he had<br \/>\nborrowed money.  By this FIR, Mr Anandjiwala has submitted that the<br \/>\nsaid Jayantbhai could be said to be the main accused and the only one<br \/>\nwho is responsible for the fraud alleged in the present FIR.\n<\/p>\n<p>3.1\tMr<br \/>\nAnandjiwala has invited this Court&#8217;s attention to the fact that the<br \/>\npresent applicant is not named in the FIR and therefore even<br \/>\notherwise also the applicant deserves to be enlarged on bail.  He has<br \/>\nfurther invited this Court&#8217;s attention to the Choksi committee&#8217;s<br \/>\nreport and submitted that the Choksi committee&#8217;s report has also made<br \/>\ncertain surmises and inferences which cannot be said to be germane<br \/>\nfor declining the bail to the applicant.  He has submitted that<br \/>\nthough he cannot claim that the applicant is on a better footing than<br \/>\nthose who are enlarged on bail, however, on the ground of parity the<br \/>\napplicant deserves to be enlarged on bail.\n<\/p>\n<p>4.\tMr<br \/>\nP.D Bhate, learned APP has appearing for the respondent State has<br \/>\nsubmitted that the fraud is in respect of about 2405 fictitious<br \/>\naccounts out of which the present applicant has signed loan documents<br \/>\nin respect of 2129 accounts which clearly goes to show that the<br \/>\npresent applicant cannot escape from his liability and involvement in<br \/>\nthe entire fraudulent activity which had been going on in the<br \/>\nparticular branch of the Bank.  Mr Bhate has further submitted that<br \/>\nthe Choksi committee has also made specific observations which is<br \/>\nforming part of the charge-sheet that the present applicant and the<br \/>\nco-accused Jayantbhai Shah were infact sitting on the same floor and<br \/>\nhaving cabins adjacent to each other with only a glass partition in<br \/>\nbetween and therefore it cannot be said that the present applicant<br \/>\nwas unaware about the fictitious loan accounts being operated.\n<\/p>\n<p>4.1\tMr<br \/>\nBhate has also invited the attention of this Court to the Choksi<br \/>\ncommittee&#8217;s report at page 135-136 wherein the present applicant&#8217;s<br \/>\nname does figure at serial no. 46 out of the total 56 persons who are<br \/>\nalleged to be responsible for the said fraud.  Mr Bhate has submitted<br \/>\nthat the applicant cannot seek parity as the applicant is a<br \/>\nresponsible person, more particularly, holding the post of Loan<br \/>\nManager and without whose signature no loan amount could have been<br \/>\ndisbursed and that therefore the applicant&#8217;s role cannot be brushed<br \/>\naside by saying that he had merely signed the documents without<br \/>\nknowledge.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned counsel for the parties and perused the materials placed on<br \/>\nrecord.  As a result of the said exercise this Court is not inclined<br \/>\nto exercise it jurisdiction in favour of the applicant for the<br \/>\nfollowing reasons:\n<\/p>\n<p>The<br \/>\n\tChoksi committee&#8217;s report which is sought to be relied upon by Mr<br \/>\n\tAnandjiwala, learned advocate for the applicant is in no way helping<br \/>\n\tthe case of the applicant for enlarging him on bail as the Choksi<br \/>\n\treport is unequivocal in its terms indicating that the applicant has<br \/>\n\tplayed a role in the entire fraud and therefore this fact militates<br \/>\n\tagainst the applicant for enlarging him on bail.\n<\/p>\n<p>Except<br \/>\n\tthis document no other document is pressed into service for<br \/>\n\tenlarging the applicant on bail.\n<\/p>\n<p>The<br \/>\n\tfirst charge-sheet which was infact filed on 27.12.06 indicated that<br \/>\n\tin the year 2001-03 the present applicant alongwith others have been<br \/>\n\tinvolved in misappropriation against the gold securities.  In the<br \/>\n\tyear 2001 the applicant is said to have been involved in a fraud<br \/>\n\tamounting to Rs. 10,50,000\/-.  In the year 2003 the applicant is<br \/>\n\tshown to having been involved in around 52 loan cases amounting to<br \/>\n\tRs. 19,23,500 and temporary misappropriation to the tune of Rs.<br \/>\n\t1,40,500\/-.  Thereafter in the year 2004, the applicant appears to<br \/>\n\thave been involved in 749 accounts amounting to Rs. 4,33,00,000\/-<br \/>\n\tand temporary misappropriation to the tune of Rs. 24,94,000\/-.  In<br \/>\n\tthe year 2005, the applicant is said to having been involved in<br \/>\n\taround 692 cases amounting to Rs. 4,42,61,500\/-.  Again in the year<br \/>\n\t2006, the involvement of the applicant is clearly mentioned in 817<br \/>\n\tcases amounting to Rs. 5,84,00,000\/-.\n<\/p>\n<p>The<br \/>\n\tapplicant cannot seek parity with other accused as in their cases<br \/>\n\teither the directors have been released or the officers whose names<br \/>\n\thave not been figuring in the list of responsible persons as per the<br \/>\n\tChoksi committee&#8217;s report are released.  It is not the case with the<br \/>\n\tpresent applicant who is a loan manager of the bank and figuring in<br \/>\n\tthe list of the responsible persons as per the aforesaid report.\n<\/p>\n<p>This<br \/>\n\tCourt has enlarged the valuers on temporary bail as they had shown<br \/>\n\twillingness to deposit Rs. 50 lakhs in installments.  The valuers<br \/>\n\twere enlarged on temporary bail as the complainant bank has<br \/>\n\tconsented and submitted that there was no objection to the valuers<br \/>\n\tbeing enlarged on temporary bail as they were willing and ready to<br \/>\n\tdeposit Rs. 50 lakhs in installments with the Court and the Bank.<br \/>\n\tThe valuers were enlarged on temporary bail keeping in view their<br \/>\n\tcontract with the bank and the fact that the valuers were not the<br \/>\n\temployees of the bank and their case cannot be equated with that of<br \/>\n\tthe present applicant who was actually the manager and without whose<br \/>\n\tsignatures the loan amount could not have been disbursed at all.  In<br \/>\n\tview of this the enlarging of the valuers on temporary bail would be<br \/>\n\tof no avail to the present applicant.\n<\/p>\n<p>It<br \/>\n\talso deserves to be noted that the applicant is a signatory in<br \/>\n\talmost all the fictitious loan accounts and the details which are<br \/>\n\trequired to be filled in by the loan account holder against loan<br \/>\n\tindicate that the details like the address of the business, the<br \/>\n\taddress of the applicant and other details were required to be<br \/>\n\tfilled in.  One specimen copy of such papers was shown to the court<br \/>\n\twherein the fictitious loan account holder had not bothered to fill<br \/>\n\tin the form which on the face of it appears to be a document not<br \/>\n\tcapable of inspiring any confidence at all.  Now such kind of<br \/>\n\tdocuments have been signed by the applicant as per the case of the<br \/>\n\tprosecutor and therefore prima facie it can be said that his<br \/>\n\tinvolvement cannot be ruled out.\n<\/p>\n<p>Thus<br \/>\n\tin view of the over all facts and circumstances and prima facie case<br \/>\n\tand nature of evidence as well as the prosecution&#8217;s apprehension<br \/>\n\tthat the applicant being a responsible officer of the bank, his<br \/>\n\tlikelihood of influencing the witnesses during trial militate<br \/>\n\tagainst the applicant being enlarged on bail.\n<\/p>\n<p>6.\tIn<br \/>\nview of the aforesaid discussion, this Court is not inclined to<br \/>\nexercise extraordinary jurisdiction for enlarging the applicant on<br \/>\nregular bail and therefore this application deserves to be rejected.<br \/>\nAccordingly, application is rejected.
