Munna Mahto\n                                               Versus\n                                       STATE OF BIHAR\n                                             -----------\n<\/pre>\n<p>3\/      21.01.2011              Learned counsel for the petitioner seeks permission to<\/p>\n<p>                      withdraw the application of petitioner no.1 inasmuch as during the<\/p>\n<p>                      pendency of the application he has been arrested.<\/p>\n<p>                                Such permission is accorded.\n<\/p>\n<p>                                Accordingly, the application of petitioner no.1 is<\/p>\n<p>                      dismissed as withdrawn.\n<\/p>\n<p>                                Heard learned counsel for the petitioner no. 2 and<\/p>\n<p>                      learned counsel for the State.\n<\/p>\n<p>                                Dead body of Arjun Yadav is recovered killed by<\/p>\n<p>                      unknown miscreants. Submission of the learned counsel for the<\/p>\n<p>                      petitioner is that save and except suspicion, there is no material to<\/p>\n<p>                      connect him with killing of the deceased.<\/p>\n<p>                                Taking that into consideration, prayer of the petitioner<\/p>\n<p>                      no. 2 is allowed.\n<\/p>\n<p>                                In the event of arrest or surrender within one month<\/p>\n<p>                      from the date of receipt\/production of a copy of this order in<\/p>\n<p>                      connection with Ballia P.S. Case No. 26 of 2010 above named<\/p>\n<p>                      petitioner no.2 shall be released on bail on furnishing bail bond of<\/p>\n<p>                      Rs. 10,000\/- (ten thousand) with two sureties of the like amount<\/p>\n<p>                      each to the satisfaction of C.J.M., Begusarai subject to the<\/p>\n<p>                      conditions as laid down under Section 438(2) of Cr.
