BHATT FOR TANNA\nASSOCIATES  for\n the  Appellant \nMR KV SHELAT for \nRespondent \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/09\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1\t\tChallenge<br \/>\nin this Appeal filed under Section 411 of the Bombay Provincial<br \/>\nMunicipal Corporations  Act, 1949 (`BPMC Act&#8217; for short) is to the<br \/>\ncorrectness of the judgment and order dated  26.12.1989, rendered in<br \/>\nMunicipal Valuation Appeal No.12401 of 1987 by the learned Judge,<br \/>\nSmall Causes Court, Ahmedabad, by which  the Municipal Valuation<br \/>\nAppeal, filed by the respondent under Section 406 of the Act, has<br \/>\nbeen partly allowed and thereby the Gross Rateable Value (&#8220;GRV&#8221;<br \/>\nfor short) was fixed at Rs.43,392\/-for both the amalgamated units,<br \/>\nfor the Assessment Year 1987-88.\n<\/p>\n<p>2\t\tMr.\n<\/p>\n<p>Bhaskar P. Tanna, learned Senior Counsel  for the appellant-Ahmedabad<br \/>\nMunicipal Corporation, submitted that the order which is impugned in<br \/>\nthe Appeal is cryptic order without assigning any reasons and,<br \/>\ntherefore, the same is required to be quashed and set aside and<br \/>\nMunicipal Valuation Appeal No.12401 of 1987 be restored and remanded<br \/>\nto the files of  the learned  Judge, Small Causes Court, Ahmedabad,<br \/>\nfor deciding the same afresh, after giving ample opportunity of<br \/>\nleading the evidence to both the parties strictly in accordance with<br \/>\nlaw.\n<\/p>\n<p>3\t\tMr.\n<\/p>\n<p>K.V .Shelat, learned Advocate for the respondent  submitted that  the<br \/>\norder impugned  in the Appeal  is not cryptic order.  The learned<br \/>\nJudge, Small Causes Court, Ahmedabad, has assigned reasons and fixed<br \/>\nthe GRV at Rs. 33,792\/- for  Unit No. 1, admeasuring 2,500 sq.<br \/>\nmeters, bearing Survey No. 27\/2  whereas  fixed  the GRV  at Rs.<br \/>\n54,000\/- for Unit No.2, admeasuring 400 sq. meters, bearing Survey<br \/>\nNo. 27\/2\/1. It is submitted that the Unit No.2  was initially  let<br \/>\nout  and, therefore,  the respondent has filed Appeal in relation to<br \/>\nthe Unit No.2  only and not in relation to the Unit No.1. It is,<br \/>\ntherefore, submitted that,  if this Court is desirous of remanding<br \/>\nthe matter, then, may  clarify that the learned Judge,  Small Causes<br \/>\nCourt, Ahmedabad, shall decide the GRV  with respect to the Unit No.2<br \/>\nonly. He, therefore, urged to pass  an appropriate order.\n<\/p>\n<p>4\t\tWe<br \/>\nhave considered the submissions advanced by Mr. Bhaskar Tanna,<br \/>\nlearned Senior Counsel  for the appellant  and  Mr.  K.V. Shelat,<br \/>\nlearned Advocate for the respondent.  We have also perused the<br \/>\nimpugned order.  Upon perusal  of the impugned order,  it is seen<br \/>\nthat the learned  Judge,  Small Causes Court, Ahmedabad, has  fixed<br \/>\nthe GRV at Rs. 43,392\/-for both the amalgamated units  for the<br \/>\nAssessment Year 1987-88. Therefore, while remanding the matter, we<br \/>\ncannot direct the learned Judge of the  Small Causes Court,<br \/>\nAhmedabad,  shall decide the GRV afresh for the Unit No.2  only.<br \/>\nSince  the Municipal Valuation Appeal No.12401 of 1987 was filed for<br \/>\nboth the amalgamated  units,  it would be open for the learned Judge<br \/>\nof the Small Causes Court, Ahmedabad, to decide the issue raised in<br \/>\nthis Appeal in connection with the property in question.\n<\/p>\n<p>5\t\tFor<br \/>\nthe foregoing reasons, the Appeal succeeds and accordingly it is<br \/>\nallowed.   The order impugned  in the Appeal is quashed and set<br \/>\naside.  The Municipal Valuation Appeal No.12401 of 1987  is restored<br \/>\nand remanded to the files of the learned Judge, Small Causes Court,<br \/>\nAhmedabad, for deciding the same  afresh after giving ample<br \/>\nopportunity of leading the evidence to both the parties strictly in<br \/>\naccordance with law and also considering the averments made in the<br \/>\nappeal memo, by assigning reasons.
