They are aggrieved by<\/p>\n<p>                     the letter of the State Government as contained in Memo No 966 dated<\/p>\n<p>                     14.12.1995 (Annexure-17) which seeks to clarify the position that all the<\/p>\n<p>                     posts of Teachers beyond the staffing pattern (Manak Mandal), upon the<\/p>\n<p>                     Ordinance taking over the management and control of Sanskrit Schools<\/p>\n<p>                     being issued, stood abolished. The Ordinance being Bihar Ordinance No<\/p>\n<p>                     32 of 1989 being the Bihar Non-Government Sanskrit School<\/p>\n<p>                     (Management and Control) Ordinance, 1989 was assented to by the<\/p>\n<p>                     Governor on 16th December, 1989 and published in the Bihar Gazette on<\/p>\n<p>                     18th December, 1989.\n<\/p>\n<p>                                      Counter affidavits and rejoinders have been filed. With<\/p>\n<p>                     consent of parties, this writ application is heard at this stage itself for final<\/p>\n<p>                     disposal.\n<\/p>\n<p>                                      In my view, it is not necessary to delve into rival<\/p>\n<p>                     contentions inasmuch as the issue has squarely been decided by this Court<\/p>\n<p>                     on several occasions including one of the last judgment being in the case<\/p>\n<p>                     of Deo Shankar Jha and others -Versus- the State of Bihar and others<\/p>\n<p>                     since reported in 2010 (4) PLJR 346. In the said decision, the relevant<\/p>\n<p>                     part is contained in paragraphs-13 and 14 of the reports which is quoted<\/p>\n<p>                     hereunder :\n<\/p>\n<blockquote><p>                                               13.                &#8220;The other issue is with regard<br \/>\n                                                                  to the letter of the State<br \/>\n                                                                  Government, as contained in<br \/>\n                                                                  Memo      No      966     dated<br \/>\n<span class=\"hidden_text\"> 3<\/span><br \/>\n    14.12.1995 (Annexure-1) to<br \/>\n    CWJC No 216 of 1998. This<br \/>\n    letter tries to create a piquant<br \/>\n    situation. It states that the<br \/>\n    Ordinance having recognized<br \/>\n    in its Manak Mandal, lesser<br \/>\n    sanctioned post, then what was<br \/>\n    sanctioned earlier for this 429<br \/>\n    Schools, the difference between<br \/>\n    the two would be deemed to be<br \/>\n    cancelled post. I may first<br \/>\n    observe that as I have held<br \/>\n    above, the Ordinance does not<br \/>\n    say so as I have held above<br \/>\n    Ordinance creates two classes<br \/>\n    of Teachers, one who would<br \/>\n    continue to get grant-in-aid<br \/>\n    notwithstanding beyond the<br \/>\n    sanction (Manak Mandal) of<br \/>\n    the Ordinance and the other<br \/>\n    who fell within the Manak<br \/>\n    Mandal (staffing pattern) of<br \/>\n    the Ordinance who would get<br \/>\n    Government rates. There was<br \/>\n    no question of cancellation of<br \/>\n    the sanctions. Learned counsel<br \/>\n    for the State submitted that at<br \/>\n    least this letter can be taken to<br \/>\n    be     effective    prospectively<br \/>\n    cancelling the post after 14th<br \/>\n    December, 1995. He states that<br \/>\n    upto this date, all Teachers<br \/>\n    whether Science or not, have<br \/>\n    been paid. Effectively, Science<br \/>\n    Teachers are to be excluded by<br \/>\n    operation of this letter. In my<br \/>\n    view, this letter assumes that<br \/>\n    the effect of Ordinance was<br \/>\n    cancellation of sanctioned post<br \/>\n    beyond the Manak Mandal<br \/>\n    which in fact is not the<br \/>\n    intention of the Ordinance.\n<\/p><\/blockquote>\n<p>    However, I may not be<br \/>\n    required to deal on this aspect<br \/>\n    any more as this issue has<br \/>\n    recently been set at rest by a<br \/>\n    Division Bench of this Court in<br \/>\n    the case of The Bihar Sanskrit<br \/>\n    Shiksha Board -Versus- the<br \/>\n    State of Bihar &amp; Others (LPA<br \/>\n    No 656 of 2010) being<br \/>\n<span class=\"hidden_text\">  4<\/span><br \/>\n      judgment dated 08.04.2010. In<br \/>\n      that case, identical issue was<br \/>\n      involved. A learned Single<br \/>\n      Judge of this Court had<br \/>\n      granted similar prayer of that<br \/>\n      writ petitioner for payment of<br \/>\n      his salary as a Science Teacher<br \/>\n      after 1995.      State and the<br \/>\n      Board resisted on basis of this<br \/>\n      very letter being Memo No 966<br \/>\n      dated 14.12.1995.       Learned<br \/>\n      Single Judge held the said<br \/>\n      letter to be ineffectual and in<br \/>\n      words of the Division Bench a<br \/>\n      dead letter as noted in<br \/>\n      paragraph-8 thereof. If it is a<br \/>\n      dead letter then nothing more<br \/>\n      is required to be done but to<br \/>\n      perform the last rites thereof<br \/>\n      and forget about it as if that<br \/>\n      letter never existed. If the<br \/>\n      letter did not exist then the<br \/>\n      position would be in view of the<br \/>\n      judgment of the Division<br \/>\n      Bench and what I have held<br \/>\n      earlier that all Science<br \/>\n      Teachers and all Teachers,<br \/>\n      whose services were approved<br \/>\n      being on sanctioned post prior<br \/>\n      to the Ordinance or whose<br \/>\n      posts was sanctioned and<br \/>\n      services approved during the<br \/>\n      Ordinance period, would be<br \/>\n      deemed to be Teachers entitled<br \/>\n      to Government grant-in-aid at<br \/>\n      the rate that were being paid<br \/>\n      prior to the Ordinance subject<br \/>\n      to such increments which may<br \/>\n      be due.\n<\/p>\n<p>14.   On similar reasoning, a similar<br \/>\n      letter of the State Government<br \/>\n      being issued under Memo No<br \/>\n      1056 dated 21.12.1995 which<br \/>\n      deals        with       purported<br \/>\n      cancellation       of     Primary<br \/>\n      Teacher posts which were<br \/>\n      sanctioned by letter No 957<br \/>\n      dated 18.11.1989 cannot also<br \/>\n      stand because the import of<br \/>\n      this letter is identical to that of<br \/>\n<span class=\"hidden_text\">                                   5<\/span><br \/>\n                                                    the letter dated 14th December,<br \/>\n                                                    1995 which the Division Bench<br \/>\n                                                    has already held to be a dead<br \/>\n                                                    letter. This letter of 1995 is<br \/>\n                                                    also a dead letter.&#8221;\n<\/p>\n<p>                        Thus, the impugned letter under Memo No 966 dated<\/p>\n<p>          14.12.1995 (Annexure-17) being a dead letter is quashed as such. The<\/p>\n<p>          position would be that all those Teachers, who were working on duly<\/p>\n<p>          sanctioned post prior to Ordinance aforesaid, would continue and cannot<\/p>\n<p>          be deemed to be dismissed and would be required to be paid their<\/p>\n<p>          remunerations from the grant-in-aid which is required to be given by the<\/p>\n<p>          State to the Schools.\n<\/p>\n<p>                        The writ application is, thus, allowed in the same terms as<\/p>\n<p>          the aforesaid judgment in the case of Deo Shankar Jha (supra) and it is<\/p>\n<p>          expected that the dues of the petitioners would be paid at the earliest but<\/p>\n<p>          not later than three months from today.\n<\/p>\n<p>M.E.H.\/                                         (Navaniti Prasad Singh)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
