Government Pleader\n\t\n:ORDER\n<\/pre>\n<p>\tThis writ petition has been filed to direct the second respondent to<br \/>\nconsider the petitioner&#8217;s representation dated 30.08.2008 and stop if any<br \/>\nconstructions made by the respondents in front of the petitioners property in<br \/>\nthe highway puramboke land of Kaliyakavilai-Kollemcode road side situated in<br \/>\nRe.Survey No.38\/1 of Choozhal village, Vilavan Code Taluk, Kanyakumari District.\n<\/p>\n<p>\t2. Heard Ms.Punitha Devakumar, learned counsel for the petitioners and<br \/>\nalso, Mr.R.Janakiramulu, learned Special Government Pleader who took notice on<br \/>\nbehalf of the respondents.\n<\/p>\n<p>\t3. The grievance of the petitioner as stood exposited from the affidavit<br \/>\naccompanying the writ petition as well as from the representation made by the<br \/>\nlearned counsel for the petitioner, is to the effect that the representation<br \/>\ndated 30.08.2008  submitted to the second respondent viz., the President,<br \/>\nChoozhal Village Panchayat, Kollemcode Post, Kanyakumari District evoked no<br \/>\npositive response. Hence, this writ petition.\n<\/p>\n<p>\t4. The learned counsel for the petitioner would submit that the<br \/>\npetitioners are having one house at Re.Survey No.38\/1 of Choozhal Village,<br \/>\nVilavan Code Taluk, Kanyakumari District; however, the second respondent viz.,<br \/>\nthe President, Choozhal Village Panchayat, Kollemcode Post, Kanyakumari District<br \/>\nis trying to put up some building so as to obstruct the access to the<br \/>\npetitioner&#8217;s building.\n<\/p>\n<p>\t5. Heard the learned Special Government Pleader.\n<\/p>\n<p>\t6. Hence, in these circumstances, the following direction is given:<br \/>\n\tOn receipt of a copy of this order, the second respondent viz., the<br \/>\nPresident, Choozhal Village Panchayat, Kollemcode Post, Kanyakumari District<br \/>\nrespondent shall consider the representation of the petitioner dated 30.08.2008<br \/>\npurely on merits within a period of fifteen days from the receipt of a copy of<br \/>\nthis order after giving due opportunity of being heard to the petitioner.\n<\/p>\n<p>\t7. With the above said direction, this writ petition is disposed of.
