“t,,O’net’_P~ra’veen Kumar was the inmate of the car<\/p>\n
inspired withrespondent No.2. The car was driven by one<\/p>\n
‘x_Chand.ra’g_Kurnar who was respondent No.3 before the<\/p>\n
A “:l:”TA,riVlb”d\u00abna| and his name was deleted from the case. The car<\/p>\n
.’ at about 1.10 a.m. in the night, hit against a stationary<\/p>\n
%\/<\/p>\n
Eorry which was parked on the road side, as a _result,<\/p>\n
Praveen Kumar died. The poiice after investigati\u00abo’nIf”h:a=i!Ae<\/p>\n
fiied the charge–sheet against one Chandra–A4″t(uvnstar;”-the”<\/p>\n
driver of the car for rash and negiiigentddtiyvirigg ‘a’ndj_fd.r<\/p>\n
causing death by negiigence.\n<\/p>\n
2. The insurer admits’i’i\u00bbtVhe occurr.en’ce’ oiiafcfcident,
\ncoverage of ii”iSUFafiCL3.;Mi}LJt .it”ri.a.t Chandra Kumar
\nwas not the driver   driver who
\nwas not  at the behest of
\nthe \ufb01etitioneqr  Chandra Kurnar as
\nthe arzvf\u00e9rro  insurer. The Tria! Court
\nupon coimsfideratigorii’Loftdtiie’:”ev~i’dence, has directed insurer to<\/p>\n
satisfy the 4a’w;:;ird..withv. right of recovery from the owner of<\/p>\n
 .-.Athe:c._c’ar;_~-Th\ufb01ownfeirtieiivng aggrieved by the award, has fiied<\/p>\n
  “ft is the contention of the learned counsei for<\/p>\n
“”ifficitiwei._i_nsu’rer that they’ had engaged a retired CB1 Officer to<\/p>\n
 ‘d.o'””forivate investigation into the matter. In the<\/p>\n
 “investigation, it is found that it was one Rahui who was not<\/p>\n
&\/<\/p>\n
holding driving licence was driving the car at the time of<\/p>\n
accident. The police have concocted and implicated <\/p>\n
Chandra Kunsar as driver in order to fasten liabiiity  -1~ <\/p>\n
insurer dishonestly.\n<\/p>\n
4. The insurer has not placed cred__Et>1i’e.mater_ia’l to V’ <\/p>\n
prove that one Rahul was the driv”e\u00abrV?V”.FheV.charge:9.:shE?et”‘ <\/p>\n

 of the report of a private agency to hold Rahul was<\/p>\n

was not the driver, the insurer cannot avoid iiabiiity and<\/p>\n
