Heard learned counsel for the petitioner, State as well as the Accountant General.\n<\/p>\n<p>2.  The petitioner was appointed as Jansewak under the Project Executive Officer, Murliganj on 26.11.1969. He passed Hindi noting and drafting examination, on 30.7.1972. He was given first time bound promotion on 1.4.1981 and 2nd time bound promotion was not given to the petitioner which is due since 26.11.1994. He retired from service on 28.2.2001 from Block Office, Saharsa as Jansewak. Petitioner&#8217;s case is that he represented the matter regarding the second time bound promotion. The Deputy Collector (Establishment) issued a letter vide Letter No. 46-2 dated 29.2.2000 to the Block Development Officer, Saharsa regarding 2nd time bound promotion and also asked to send the appointment letter as well as the letter of 1st time bound promotion to the petitioner.\n<\/p>\n<p>3.   Petitioner&#8217;s case is that despite the letter of recommendation nothing was done and he was not given second time bound promotion. This application has been filed for direction to the respondents for giving statutory interest to the petitioner alongwith full pension and rest amount of 10% gratuity. He has also prayed for confirming the 2nd time bound promotion w.e.f. 26.11.1994 and to recalculate all the post retiral benefits.\n<\/p>\n<p>4.  Counter affidavit has been filed by the State stating that as the petitioner has been paid Gratuity, Leave Encashment, Group Insurance, Provisional Pension and Regular Pension has been sanctioned by the Accountant General, Bihar which is being paid to the petitioner by District Treasury Officer and regarding second time bound promotion it has been stated that it will be given to the petitioner after the confirmation of 1st time bound promotion. In this regard a proposal has already been sent to the Commissioner Koshi Division for confirmation. As soon as 1st time bound promotion is confirmed the 2nd time bound promotion will be given to the petitioner.\n<\/p>\n<p>5.   It has been submitted in the counter affidavit that 2nd time bound promotion is due to the petitioner w.e.f. 20.11.94 which was delayed due to non-availability of C.R. of the preceeding years and incomplete entries in the Service Book. It has further been submitted that a proposal for confirmation of 1st time bound promotion has been sent to the Commissioner, Koshi Division, Saharsa and after the confirmation the 2nd time bound promotion will be given to the petitioner. With regard to the payment of rest amount of pension and gratuity, it is stated that the final pension and gratuity has been sanctioned by A.G. Bihar, and rest amount mentioned above is being paid by Treasury Officer, Nalanda.\n<\/p>\n<p>6.  Considering the fact that this counter affidavit was filed in the year, 2003 and neither further development in this regard has yet been made on behalf of the State nor any supplementary counter affidavit has been filed this application is being disposed of with a direction to the respondents for taking steps regarding payment of rest amount of pension and gratuity alongwith 2nd time bound promotion to the petitioner w.e.f. 26.11.1994. Petitioner should be given all consequential benefits arising out of second time bound promotion, such as arrears of pension and gratuity and leave encashment within a period of four weeks from the date of production\/communication of the order. An order should be passed by the respondent regarding 1st time bound promotion and second time bound promotion as well as all consequential benefits.\n<\/p>\n<p>7.
