RAVINDRAN, J.\n              ---------------------------------------\n                  W.P.(C) No.26924 OF 2009\n              ---------------------------------------\n         Dated this the 24th day of September, 2009.\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      Heard Sri.T.J.Michael, the learned counsel appearing for the<\/p>\n<p>petitioners and Sri.T.A.Shaji, the learned standing counsel<\/p>\n<p>appearing for the Mahatma Gandhi University.<\/p>\n<p>      2. The petitioners appeared for the eighth semester B.Tech<\/p>\n<p>Degree examination in Electrical and Electronics Engineering<\/p>\n<p>conducted by the Mahatma Gandhi University in May\/June 2009.<\/p>\n<p>The results were published in August 2009. The petitioners failed<\/p>\n<p>in various papers of the eighth semester examination. They have<\/p>\n<p>therefore applied for revaluation of their answer scripts by<\/p>\n<p>submitting Exhibits P2, P5, P8, P11, P14, P17, P20, P23 and P26<\/p>\n<p>applications. They have also paid the requisite fee.<\/p>\n<p>      3.  The petitioners submit that they have passed all the<\/p>\n<p>other semester examinations and that if their answer scripts are<\/p>\n<p>revalued they are sure to secure a pass in the eighth semester<\/p>\n<p>examination.    They also submit that they have been offered<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.26924\/2009             2<\/span><\/p>\n<p>employment and that unless their answer scripts are revalued<\/p>\n<p>expeditiously, they will be put to serious prejudice. In this writ<\/p>\n<p>petition, the petitioners seek a direction to the respondents to<\/p>\n<p>revalue their answer scripts expeditiously.<\/p>\n<p>       4. Sri.T.A.Shaji, the learned standing counsel appearing for<\/p>\n<p>the Mahatma Gandhi University submits that petitioners&#8217; answer<\/p>\n<p>scripts cannot be singled out and revalued as it will lead to loss<\/p>\n<p>of confidentiality. He also submits that as per the Examination<\/p>\n<p>Manual, the University requires 81 clear days from the date of<\/p>\n<p>publication of the results to complete the revaluation process. He<\/p>\n<p>further submits that the petitioners&#8217; application for revaluation<\/p>\n<p>will be considered and their answer scripts revalued, if the<\/p>\n<p>applications are in order, within the aforesaid period.<\/p>\n<p>       5. The Examination Manual is not a statutory regulation. It<\/p>\n<p>is a Manual prepared by the University for its guidance.       The<\/p>\n<p>stipulations in the Examination Manual cannot, in my opinion,<\/p>\n<p>operate to the detriment of students. A Division Bench of this<\/p>\n<p>Court has in <a href=\"\/doc\/1085668\/\">University of Kerala v. Sandhya P.Pai<\/a> (1991(1)<\/p>\n<p>KLT 812) held that the University should hurry with applications<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.26924\/2009             3<\/span><\/p>\n<p>for revaluation without wasting any time and that unless<\/p>\n<p>applications for revaluation are expeditiously disposed of, it will<\/p>\n<p>cause serious prejudice to the students. I am therefore of the<\/p>\n<p>considered opinion that University should not wait for the expiry<\/p>\n<p>of 81 clear days from the date of publication of the results to<\/p>\n<p>complete the revaluation process.\n<\/p>\n<p>       I accordingly dispose of this writ petition with a direction to<\/p>\n<p>the respondents to complete the revaluation of the answer scripts<\/p>\n<p>described in Exhibits P2, P5, P8, P11, P14, P17, P20, P23 and P26<\/p>\n<p>applications and to communicate the results to the petitioners<\/p>\n<p>within six weeks from the date on which the petitioners produce a<\/p>\n<p>certified copy of this judgment before the Controller of<\/p>\n<p>Examinations, Mahatma Gandhi University.\n<\/p>\n<\/p>\n<p>                                          P.N.
