It is supported by<br \/>\n\taffidavit sworn by G.P.Rathod, Under Secretary, Legal Department,<br \/>\n\tGandhinagar. In the application it is stated  that because of<br \/>\n\tinter-department and intra-department proceedings, delay has been<br \/>\n\tcaused. It is also pleaded that in the Government, files are moving<br \/>\n\tfrom one table to another table for obtaining necessary sanction.<br \/>\n\tIt is also pleaded that there was sufficient cause which prevented<br \/>\n\tthe applicant in filing appeal in time. It is, therefore, prayed<br \/>\n\tthat the delay may be condoned.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced by Mr.R.C.Kodekar, learned APP<br \/>\n\tfor the applicant &#8211; State of Gujarat, and Mr.N.D.Gohil,<br \/>\n\tlearned advocate for respondents No.1 to 3 and on perusal of the<br \/>\n\taverments made in the application, which have remained<br \/>\n\tuncontroverted and the celebrated principles governing the<br \/>\n\tdiscretionary  exercise of power conferred under Section 5 of the<br \/>\n\tAct, so also the reported decisions of the Hon&#8217;ble Supreme Court<br \/>\n\tconstruing Section 5 of the Act liberally, we are of the considered<br \/>\n\topinion that there was sufficient cause which prevented the<br \/>\n\tApplicant from filing the Appeal in time.  The record does not<br \/>\n\tindicate that there was any inaction or negligence on the part of<br \/>\n\tthe applicant in prosecuting the appeal. The applicant has never<br \/>\n\tabandoned the lis. The explanation offered by the Applicant for<br \/>\n\tcondonation of delay is not only plausible, but acceptable.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, according to us, this application deserves to<br \/>\n\tbe allowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed.   Delay of 16 days caused in filing the above<br \/>\n\tproceedings is condoned. Rule is made absolute.\n<\/p>\n<p>Registry<br \/>\n\tis directed to list the Criminal Misc.
