The Mamlatdar and ALT, Chaurasiya, after couple of<br \/>\n\trounds of remands had by his order dated 28.2.1994 held that the<br \/>\n\tpetitioner does not hold any land in excess of ceiling limit. The<br \/>\n\tState preferred appeal against the said order of Mamlatdar before<br \/>\n\tthe Deputy Collector who by his order dated 19.2.1996 remanded the<br \/>\n\tproceedings before the Mamlatdar for fresh consideration. The<br \/>\n\tpetitioner challenged the said order of Deputy Collector before<br \/>\n\tGujarat Revenue Tribunal in Revision Application TEN.B.S.<br \/>\n\t72\/1996.This revision application came to be disposed of by a<br \/>\n\tdecision dated 14.7.1998 confirming the order passed by the Deputy<br \/>\n\tCollector upon which the present petition has been filed by the<br \/>\n\tpetitioner original land holder.\n<\/p>\n<p>In<br \/>\n\tthe impugned order, the Tribunal enlisted following five factors<br \/>\n\twhich were not considered by Mamlatdar upon which remand was<br \/>\n\tnecessary :\n<\/p>\n<p> (i)<br \/>\n\tDeletion of the portion of the land converted into N.A. And sold out<br \/>\n\tto a third party from the total holding of the applicant, which<br \/>\n\tapparently was found not to be in order;\n<\/p>\n<p>(ii)<br \/>\n\tCalculation of the total Jirayat equivalent land as against the<br \/>\n\ttotal holding of the applicant based on the canal certificate and<br \/>\n\tother details was also not found to be in order;\n<\/p>\n<p>(iii)<br \/>\n\tdisposal of the portion of the land converted into N.A. Since 6.6.87<br \/>\n\tonwards, by the parties concerned was apparently done without<br \/>\n\tobtaining any prior permission from the competent authority required<br \/>\n\tunder the provisions of the Act, and which, therefore, was also not<br \/>\n\tin order;\n<\/p>\n<p>(iv)<br \/>\n\tNon consideration of the total holding of land as on 1.4.76 by the<br \/>\n\tconcerned original owner of the same on that day under the<br \/>\n\tprovisions of the  Act, was apparently the lapse on the part of the<br \/>\n\tconcerned authorities which ought to have also been taken into<br \/>\n\taccount; and<\/p>\n<p>(v)<br \/>\n\tnon-consideration of O-A 13-Gs. of land at the village Dumas held by<br \/>\n\tthe applicant as against the total holding of the other lands was<br \/>\n\talso an apparent lapse under the provisions of the  Act  <\/p>\n<p>Ordinarily,<br \/>\n\tthis Court in exercise of writ jurisdiction would not interfere in a<br \/>\n\tpure order of remand. However, in the present case, proceedings were<br \/>\n\talready remanded twice before. In the proceedings under the Gujarat<br \/>\n\tAgricultural Land Ceiling Act, it is all the more necessary that on<br \/>\n\tone hand land owner can enjoy his land free from any cloud and on<br \/>\n\tthe other hand, if the land is found surplus in excess of ceiling<br \/>\n\tlimit, same can be utilised by the Government for distribution<br \/>\n\tamongst different categories of persons who needs such lands for<br \/>\n\ttheir cultivation.\n<\/p>\n<p>From<br \/>\n\tthe perusal of the factors enlisted by the Tribunal, it can be seen<br \/>\n\tthat same pertained to some arguable disputed question of law and<br \/>\n\tfacts or mixed questions of law and facts. Even if the Mamlatdar had<br \/>\n\tnot taken into account such factors before rendering his decision,<br \/>\n\tit is always open for the Tribunal to give its own finding and come<br \/>\n\tto just conclusion on such basis. Since I find that as per the<br \/>\n\tTribunal also no further evidence is required to be brought on<br \/>\n\trecord, remand to the Mamlatdar would serve no useful purpose. In<br \/>\n\tany case, if some additional documents are to be taken on record, it<br \/>\n\tis well within the power of the Tribunal to so permit.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, I find that order of remand as provided by the<br \/>\n\tDeputy Collector as well as by the Tribunal would result into<br \/>\n\tmiscarriage of justice. In facts of the case, therefore, while<br \/>\n\tsetting aside order of the Gujarat Revenue Tribunal dated 14.7.1998,<br \/>\n\tthe revision application is revived. The Tribunal is requested to<br \/>\n\thear the revision application afresh and ignore the order passed by<br \/>\n\tthe Deputy Collector for remand of the proceedings, decide on<br \/>\n\tmerits, on the basis of available evidence on record including if<br \/>\n\tany additional evidence is so permitted by the Tribunal to be<br \/>\n\tbrought on record, the question of land if any held by the<br \/>\n\tpetitioner in excess of ceiling limit and all connected and<br \/>\n\tincidental questions thereof. This may be done expeditiously and<br \/>\n\tpreferably within six months from the date of receipt of a copy of<br \/>\n\tthis order.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of.
