K.S.RADHAKRISHNAN)<\/p>\n<p>\tThis<br \/>\npublic interest litigation has been filed seeking declaration that<br \/>\nthe plans for construction of Dev Arc Complex placed by respondent<br \/>\nNos.1 &amp; 2 and  sanctioned by the AUDA vide Annexure A and the<br \/>\nbuilding use permission granted by AUDA are illegal, void and<br \/>\nagainst public policy.  Other consequential reliefs  have also been<br \/>\nprayed for.\n<\/p>\n<p>\tPetitioner<br \/>\nwho  is an  ex-councilor of the Nagarpalika has approached this Court<br \/>\nwith the above prayers  pointing out various   violations  allegedly<br \/>\ncommitted in the construction carried out by the 2nd<br \/>\nrespondent.  It is stated in the petition that there  is<br \/>\nirregularity in amalgamation of  plots.  Further, it is also stated<br \/>\nthat there is illegality in sanctioning the building as low-rise<br \/>\nbuilding, so also  in according sanction  in the built-up area, floor<br \/>\nspace index, etc.<\/p>\n<p>\tThis<br \/>\nCourt issued notice only to 3rd respondent, and no notice<br \/>\nwas issued to other respondents and consequently, there is no<br \/>\nappearance on behalf of respondent Nos.1 &amp; 2.\n<\/p>\n<p>\tA<br \/>\ndetailed affidavit has been filed  by the Senior Town Planner of AUDA<br \/>\n on 4th February 2008.  It is stated therein that at the<br \/>\ntime of filing the writ petition, major portion of construction of<br \/>\nthe building was over. Over and above, a second affidavit  has been<br \/>\nfiled by the third respondent on 15th September 2008 which<br \/>\nhas dealt with in detail each and every  alleged violation pointed by<br \/>\nthe petitioner in the petition.  It is unnecessary to reiterate what<br \/>\nhas been stated  by AUDA in both the affidavits.  Major stress raised<br \/>\nby this Court, as stated by the learned counsel for AUDA, was that<br \/>\nthat there is no proper fire safety device, which has been dealt with<br \/>\nin the affidavit filed by AUDA.\n<\/p>\n<p>\tWith<br \/>\nregard to the contention of amalgamation of plots, it has been stated<br \/>\nin para 2 of the counter affidavit that the whole plot is an<br \/>\namalgamated plot of 3 final plots and the whole plot is having road<br \/>\nfacing 3 sides  and all roads are TP roads,  and in addition, the<br \/>\nplot is as per the permissible  limits as per regulation 10.1.3 of<br \/>\nthe building regulations.  Further, it is also stated that the<br \/>\nbuilding B  is a low rise building and as per the definition of<br \/>\nlow-rise building in the GDCR, the construction permitted is ground +<br \/>\n4 floors and no extra floors are constructed  nor extra FSI is<br \/>\ngranted and  nor additional built up area  has been permitted.<br \/>\nFurther, reference was made to  regulation 29.2(d) of the GDCR by<br \/>\nwhich it is provided that alteration in  height can be  permitted<br \/>\nunder extra-ordinary circumstances,  if any hardship is caused to the<br \/>\npublic at large.  It has been pointed out that  in the instant case,<br \/>\nthere is an auditorium on the 3rd floor of the building<br \/>\nand therefore, the hight of the building  has been  permitted to be<br \/>\nraised to 23.7 meters and therefore   inspite of the height of the<br \/>\nbuilding  being more than 16.5 meters,  it is stated that  it cannot<br \/>\nbe said that  the building is a high rise building as the<br \/>\nconstruction permitted  in the building is as per the regulations.\n<\/p>\n<p>\tFrom<br \/>\nthe affidavits filed by the Senior Town Planner, it is revealed that<br \/>\neven if there is some minor violations, those violations cannot be<br \/>\ncharacterized as major violations so as to direct demolition of the<br \/>\nbuilding which has already been constructed and shops have been<br \/>\nallotted.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, we find no reason to entertain this public<br \/>\ninterest litigation.  The same is therefore dismissed.
