NO.  20414  OF  2007\n\n                         ----------------------------------------------------\n\n                                  Dated this the 4th  July,   2007\n\n\n                                               JUDGMENT\n<\/pre>\n<p>H.L.DATTU, C.J.\n<\/p>\n<\/p>\n<p>         Petitioner   is   an   advocate   and   also     the   Chairman   of     Social<\/p>\n<p>Democratic   Party.     He   is   also   a   tax   payer.     The   primary   relief   that   he   is<\/p>\n<p>seeking in his petition is to direct sixth and seventh respondents in the writ<\/p>\n<p>petition   to   go   ahead   with   the   eviction   of   encroachers   in   the   Munnar   area<\/p>\n<p>ignoring   the   instructions   issued     by  the   Chief   Minister   of   the   State   or   any<\/p>\n<p>other authority.\n<\/p>\n<\/p>\n<p>         2.     The   basis   for   the   allegations   made   in   this   petition   is   only<\/p>\n<p>newspaper reports.  Apart from this, there is no other evidence produced by<\/p>\n<p>the petitioner in support of the assertion and allegation in the Writ Petition.<\/p>\n<p>In a scenario like this, can we entertain the so-called Public Interest filed by<\/p>\n<p>the   petitioner.     We   need   not   have   to   make   a   research   to   search   for   an<\/p>\n<p>answer for the question we have posed.   The Supreme Court in the case of<\/p>\n<p><a href=\"\/doc\/1368956\/\">Kushum   Lata  v.  Union   of   India   and   others<\/a>  ((2006)   6   SCC   180),   has<\/p>\n<p>observed as under:\n<\/p>\n<\/p>\n<blockquote><p>                   &#8220;It   is   also   noticed   that   the   petitions   are   based   on<\/p>\n<p>         newspaper   reports   without   any   attempt   to   verify   their<\/p>\n<p>         authenticity.   As  observed  by  this  Court  in several cases,<\/p>\n<p>         newspaper reports  do  not  constitute  evidence.   A petition<\/p>\n<p>         based on unconfirmed news reports, without verifying their<\/p>\n<p>         authenticity should not normally be entertained.   As noted<\/p>\n<p>         above, such petitions do not provide any basis for verifying<\/p>\n<p>         the correctness of statements made and information given<\/p>\n<p>         in the petition.  It would be desirable for the courts to filter<\/p>\n<p>         out the frivolous petitions and dismiss  them with costs as<\/p>\n<p>         aforestated so that the message goes in the right direction<\/p>\n<p>         that   petitions   filed   with   oblique   motive   do   not   have   the<\/p>\n<p>         approval of the courts.&#8221;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>W.P.(C). NO.20414 OF 2007 S<\/p>\n<p>                                                    ::  2  ::\n<\/p>\n<\/p>\n<p>         3.  Precious time of the court is being wasted in dealing with this type<\/p>\n<p>of   public   interest   litigation   where   the   allegations   are   made   in   the   petition<\/p>\n<p>solely   based   on   newspaper   reports.     In   our   view,   filing   of   this   type   of<\/p>\n<p>litigation   should   be   discouraged   as   observed   by   the   Supreme   Court   by<\/p>\n<p>rejecting the petitions at the initial stage itself.<\/p>\n<p>         4.   In view of the above, keeping in view the observations made by<\/p>\n<p>the   Supreme   Court     in   the   aforesaid   decision,   this   petition   requires   to   be<\/p>\n<p>rejected and it is rejected.
