DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.  learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tsuccessive bail application is filed under Section 439 of the Code<br \/>\n\tof Criminal Procedure in connection with first information report<br \/>\n\tregistered at CR No.I 41\/2010 with Jadar Police Station,  for the<br \/>\n\toffences punishable under Sections 307 and 504 of the Indian Penal<br \/>\n\tCode and under section 135 of the Bombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicants submits that charge<br \/>\n\tsheet is filed. He further submits that the<br \/>\n\tapplicant has roots in the society, will not flee from justice and<br \/>\n\twill cooperate with the investigation as and when called for. It is<br \/>\n\tfurther submitted that considering the allegations levelled against<br \/>\n\tthe applicant and role attributed to him, the applicant may<br \/>\n\tbe enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 41\/2010 with<br \/>\n\tJadar Police Station on executing a bond of Rs.5,000\/- (Rupees Five<br \/>\n\tthousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>shall<br \/>\n\tremain out of Idar Taluka for 3 months except for marking present;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
