Advocate\n\nHon'ble Ashok Srivastava,J.\n<\/pre>\n<p>There is an illness slip of Mr.A.K.Yadav one of the learned<br \/>\ncounsel for the revisionist but Mr. H.C.Dwivedi the second<br \/>\nlearned counsel for the revisionist is present and he is ready<br \/>\nto argue the matter. Mr. Radhey Shyam Dwivedi the learned<br \/>\ncounsel for the opposite party Dharam Raj is also present.<br \/>\nI have heard learned counsel for the parties and perused the<br \/>\nrecords.\n<\/p>\n<p>Six persons namely Shiva Nath, Shaileshwar, Kamleshwar,<br \/>\nNandoo @ Nand Lal, Nanhey &amp; Sanjay were found guilty by<br \/>\n7th Addl. C.J.M., Varanasi and were convicted and sentenced<br \/>\nto undergo various terms of imprisonment and were also<br \/>\ndirected to pay certain amounts of fine under Section 420<br \/>\nI.P.C. Feeling aggrieved by this judgment dated 16.2.1996<br \/>\npassed by the learned Addl. C.J.M., Varanasi in the criminal<br \/>\ncase no.2165, two separate criminal appeals were filed before<br \/>\nthe learned Sessions Judge, Varanasi. The appellant Nandoo<br \/>\n@ Nand Lal filed criminal appeal no.32\/96 whereas the<br \/>\nappellants Shiva Nath, Saleshwar, Kamleshwar, Nanhey and<br \/>\nSanjay filed separately the criminal appeal No.31\/96. Both<br \/>\nthe appeals were transferred to the Court of 10th Addl.<br \/>\nSessions Judge who dismissed both the appeals after hearing<br \/>\nthem on 28.11.2001.\n<\/p>\n<p> Against the above mentioned judgment of learned Addl.<br \/>\nSessions Judge, the revisionist Nandoo @ Nand Lal has filed<br \/>\ncriminal revision No.2555 of 2001, Shiv Nath, Shaileshwar<br \/>\n&amp; Kamleshwar have filed criminal revision No.2563 of 2001<br \/>\nand Nanhey and Sanjay have filed criminal revision No.2604<br \/>\nof 2001.Since these three criminal appeals are intertwined<br \/>\nthey have been heard today together as they were connected<br \/>\nto each other by an earlier order of this Court.\n<\/p>\n<p>During the pendency of these revisions before this Court it<br \/>\nappears that the complainant of the case and the revisionists<br \/>\nhave come to terms and therefore they have filed three<br \/>\nseparate compromise applications before this Court alongwith<br \/>\naffidavits in each of the revisions.\n<\/p>\n<p>From the perusal of Section 320 Cr.P.C. of the Code of<br \/>\nCriminal Procedure it is evident that Section 420 IPC is<br \/>\ncompoundable with permission of the Court.\n<\/p>\n<p>After hearing the learned counsel for both the parties I am of<br \/>\nthe view that the parties to the case have come to terms in a<br \/>\nbonafide manner and it shall be in the interest of justice and<br \/>\nthe parties that permission be granted to them to compromise.<br \/>\nIt should be mentioned here that six revisionists were found<br \/>\nguilty under Section 420 I.P.C. only. It appears necessary that<br \/>\nthe compromise deed be got verified by the C.J.M., Varanasi<br \/>\nbefore disposing of the same finally by this Court.\n<\/p>\n<p>In the above circumstances it is directed that let clear and<br \/>\nlegible photo copies of the compromise applications and<br \/>\naffidavits is sent to the learned C.J.M., Varanasi. Learned<br \/>\n C.J.M., Varanasi is directed to call in his Court all the six<br \/>\nrevisionists and the complainant of the case and verify the<br \/>\ncompromise. Learned C.J.M. is also directed to satisfy<br \/>\nhimself that the compromise is voluntary. Thereafter he shall<br \/>\nsubmit a report to this Court without delay. He will conclude<br \/>\nthe proceedings within a period of 45 days from the date he<br \/>\nreceives a certified copy of this order.\n<\/p>\n<p>Office is directed to place the matter before the Court<br \/>\nimmediately after receipt of the report from the learned<br \/>\nC.J.M., Varanasi or on 23.9.2010, whichever is earlier.\n<\/p>\n<p>Order Date :- 23.7.2010<br \/>\nIA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Shiva Nath &amp; Others vs Addl.
