Both the Writ Petitions are being disposed of by  common order, as<br \/>\ncommon question of law, and facts arise for consideration.\n<\/p>\n<p>\t3.  The petitioners in both these Writ Petitions have obtained Bachelor&#8217;s<br \/>\nDegree from a recognized University. The petitioners, had, joined graduation<br \/>\ncourse by not following the regular stream of study i.e., 10+2+3.\n<\/p>\n<p>\t4.\tThe eligibility criteria as per the statutory provisions, and the<br \/>\nguidelines laid down by the National Council for Teachers Education, for<br \/>\nadmission to B.Ed Course is graduation with 45% marks.\n<\/p>\n<p>\t5. The Government of Tamil Nadu issued the impugned Government Order,<br \/>\nlaying down that the students who have passed the graduation examination without<br \/>\ncompleting 10+2+3 system will not be eligible for B.Ed examination.  Nothing has<br \/>\nbeen disclosed in the Government Order as to under what authority of law, the<br \/>\nsaid Government Order, is issued to regulate the admission of candidates in<br \/>\ndifferent Universities, which are regulated by respondent No.3, and the<br \/>\nUniversity Act and the Statutory rules, framed therein.\n<\/p>\n<p>\t6. However, there is no necessity to deliberate on this matter any<br \/>\nfurther, as both the Writ Petitions deserves to be allowed, being fully covered<br \/>\nby the decision of the Honourable Division Bench of this Court in W.A(MD)492 of<br \/>\n2007, decided on 11.02.2008(V.Vijayalakshmi .vs. The Director of Collegiate<br \/>\nEducation, Chennai &#8211; 600 006 and others, wherein, the Honourable Division Bench<br \/>\nof this Court was pleased to lay down as under:<br \/>\n\t&#8220;4.  On the above said contention, this Court posed a question to the<br \/>\nlearned counsel appearing for the second respondent University to point out any<br \/>\nsuch requisition is available in the University to say that the candidates who<br \/>\nunderwent 10+2+3 pattern alone are eligible to join B.Ed Course, for which he is<br \/>\nunable to point out any such Regulation. However, he submitted that the<br \/>\nguidelines stated to have been issued by the Director of Collegiate Education<br \/>\nstipulate  that the candidates who have done their degree course under 10+2+3<br \/>\npattern alone are eligible to join the B.Ed Course.\n<\/p>\n<p>\t5.  Learned counsel appearing for the 3rd respondent College submitted<br \/>\nthat in identical cases, where the candidates studied degree through<br \/>\ncorrespondence course were permitted to pursue B.Ed Course, this Court passed<br \/>\norders directing the Universities and the Colleges to declare their results as<br \/>\nno valid regulations preventing such persons are found mentioned in the<br \/>\nUniversity Regulations or Statutes and hence the relief sought for by the<br \/>\nappellant can be granted.\n<\/p>\n<p>\t6.  In spite of the fact that the second respondent University has not<br \/>\nproduced any Regulation, they justified their stand.  Even the guidelines stated<br \/>\nto have been produced for our consideration. In any event, once a particular<br \/>\ndegree has been introduced\/offered by the Universities, it is for the<br \/>\nauthorities to prescribe guidelines.  As mentioned above, no such<br \/>\nguidelines\/regulations formulated by the second respondent University making the<br \/>\ncandidates like the appellant ineligible to pursue B.Ed course. In view of the<br \/>\nabove said fact, this Court has no option except to grant the relief sought for<br \/>\nby the appellant. Moreover, no valid reason is mentioned by the learned single<br \/>\nJudge for dismissing the writ petition.\n<\/p>\n<p>\t7.  For the above said reasons, the Writ Appeal is allowed setting aside<br \/>\nthe order passed by the learned Single Judge. The second respondent University<br \/>\nis directed to  declare the results of the appellant within a period of two<br \/>\nweeks from the date of receipt of a copy of this order. No costs. Connected<br \/>\nM.P(MD)No.1 of 2007 is closed.&#8221;\n<\/p>\n<p>\t7. Therefor, both the Writ Petitions are allowed. The respondents are<br \/>\ndirected to declare the result of the petitioners, and issue necessary<br \/>\ncertificates etc to the petitioner, without any further delay.\n<\/p>\n<p>\t8.
