RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n          W.P.(C).No.24912 of 2009-H\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n    Dated this the 28th day of August, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>The  petitioner  challenges   a  decision   of a<\/p>\n<p>municipality in relation to acquisition of a<\/p>\n<p>piece of land for a bus stand.      The plea was<\/p>\n<p>that the land was originally acquired for a<\/p>\n<p>cattle  market,  however   that,  it   was  later<\/p>\n<p>proposed to be put to use for the bus stand. That<\/p>\n<p>challenge failed before the learned Ombudsman for<\/p>\n<p>Local Self Government Institutions who found that<\/p>\n<p>the municipality&#8217;s proposal to establish a bus<\/p>\n<p>stand in the 1.71 acres acquired earlier for<\/p>\n<p>providing a cattle market stood with the approval<\/p>\n<p>of the Government and was covered by proper<\/p>\n<p>resolution  of  the  municipality.  It  was  also<\/p>\n<p>noticed that a civil suit was pending in the<\/p>\n<p>Munsiff&#8217;s   Court,   Chalakkudy.    The   learned<\/p>\n<p>Ombudsman issued the impugned Ext.P7 order on<\/p>\n<p><span class=\"hidden_text\">WP(C)24912\/09          -: 2 :-<\/span><\/p>\n<p> 10.11.2008. The Secretary of the Office of the<\/p>\n<p> learned ombudsman is seen to have issued copy of<\/p>\n<p> the order on 20.11.2008. At this distance of<\/p>\n<p> time, on 28.8.2009, I do not find any ground for<\/p>\n<p> this      Court  to   extend     its  discretionary<\/p>\n<p> jurisdiction     under     Article  226   of   the<\/p>\n<p> Constitution of India, to entertain a challenge<\/p>\n<p> against     Ext.P7  which    does  not  visit  the<\/p>\n<p> petitioner with any adverse civil consequences.<\/p>\n<p> The writ petition fails.
