RATHOD &amp; MR GK RATHOD for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the order passed by the Labour Court, Junagadh in Recovery<br \/>\nApplication No.55\/1991 dated 22.07.2003, whereby, the said<br \/>\napplication filed u\/s.33(C)2 of the I.D. Act by the respondent was<br \/>\nallowed and the petitioner-Corporation was directed to pay an amount<br \/>\nof Rs.11,312.40 to the respondent.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the respondent was appointed as a &#8216;temporary<br \/>\nworker&#8217; by the petitioner-Corporation. The respondent filed Recovery<br \/>\nApplication No.55\/1991 before the Labour Court, Junagadh claiming<br \/>\nwages for the period from 01.07.1989 to 21.03.1990. The Labour Court,<br \/>\nafter hearing both the sides and after considering the evidence on<br \/>\nrecord, allowed the said application. Hence, this petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Before the Court below, the respondent had produced<br \/>\ndocumentary evidence, vide Exs.13 to 24, in order to show that he had<br \/>\nrendered services with the petitioner-Corporation. Further, from his<br \/>\ncross-examination, it was established that the petitioner had not<br \/>\npaid the outstanding wages to him and had, thereby, had not followed<br \/>\nthe time-scale.\n<\/p>\n<p>4.\tLooking<br \/>\nto the facts of the case and the evidence on record, I am of the view<br \/>\nthat the Court below was completely justified in allowing the<br \/>\napplication of the respondent. I am in complete agreement with the<br \/>\nreasonings given by the Court below in the impugned order and hence,<br \/>\nfind no reasons to interfere with the same.  Even otherwise, looking<br \/>\nto the smallness of the amount involved, this Court does not find it<br \/>\nfit to disburse the order passed by the Court below.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed. Rule is discharged.<br \/>\nInterim relief, if any, stands vacated. The payment to be released<br \/>\nwithin a period of two months from today.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
