SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned judgement and award dated<br \/>\n25\/02\/2010 passed by the learned Presiding Officer, Labour Court,<br \/>\nJunagadh in Reference (L.C.J.) No. 118\/2004 by which the Labour<br \/>\nCourt, Junagadh has dismissed\/rejected the Reference.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Ms. Tejal Shah, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned judgement and award, more<br \/>\nparticularly, considering the fact that the petitioner has failed to<br \/>\nprove by leading evidence that he worked for more than 240 days in<br \/>\nthe last preceding year and considering the fact that the petitioner<br \/>\ndid not appear before the Labour Court and did not lead any evidence<br \/>\nand even did not examine himself and when the petitioner failed to<br \/>\nprove that he worked for more than 240 days in the last preceding<br \/>\nyear and consequently when the Labour Court has rejected\/dismissed<br \/>\nthe Reference, it cannot be said that the Labour Court has committed<br \/>\nan error\/illegality, which calls for the interference of this Court<br \/>\nin exercise of powers under Article 227 of the Constitution of India.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, there is no<br \/>\nsubstance in the present petition, which deserves to be dismissed and<br \/>\nis accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Balubhai vs Bharitya on 26 October, 2010 Author: M.R.
