Chatterjee,  Raja Chatterjee,  (J.R.Das,) Adv  for M\/s.<br \/>\nSinha &amp; Das, Advs. for the Respondent<br \/>\n\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered:<br \/>\nNanavati, J<br \/>\n     The appellants were convicted by the Sessions Court for<br \/>\ncommitting the\toffence punishable  under Section  307\tread<br \/>\nwith  Section  34  IPC\tand  sentenced\tto  suffer  rigorous<br \/>\nimprisonment for  ten years.  Appellant Tarak Nath Singh was<br \/>\nalso convicted\tunder Sections 25 and 27 of the Arms Act and<br \/>\nwas sentenced  to suffer  rigorous imprisonment\t for one and<br \/>\nthree years  respectively.   The High  Court  confirmed\t the<br \/>\nconviction of  the appellants  under Section  307 read\twith<br \/>\nSection\t 34   IPC  but\treduced\t the  sentence\tto  rigorous<br \/>\nimprisonment for  eight years.\t Conviction  of\t Tarak\tNath<br \/>\nSingh under  sections 25  and 27  of Arms Act was set aside.<br \/>\nAggrieved by  the conviction  and the  order of sentence the<br \/>\nappellants have filed this appeal by special leave.\n<\/p>\n<p>     What has  been found  against the appellants is that on<br \/>\nApril 23,  1979 at about 10.30 p.m. when Ramashish Singh was<br \/>\nexamining his  account books  and  counting  money  in\tthis<br \/>\n&#8216;Gaddi&#8217; (place of business) the appellants with four or five<br \/>\nunknown persons\t entered the  &#8216;Gaddi&#8217; with revolvers, knives<br \/>\nand bombs,  Tarak Nath\tSingh  fired  six  rounds  from\t his<br \/>\nrevolver and  caused injuries  to Ramashish Singh and Chhabi<br \/>\nNath (appellant\t No.2) stabbed\thim  with  a  knife  on\t his<br \/>\nabdomen.  After attacking Ramashish Singh in this manner the<br \/>\nassailants had escaped after hurling bombs.\n<\/p>\n<p>     Both the  courts below  have believed  the evidence  of<br \/>\nRamashish (PW-1) and also of PWs-2,3 10 and 11.\t Shewnarayan<br \/>\n(PW-2) was  the owner  of a  nearby tea\t stall, Lalan Tewari<br \/>\n(PW-3) was  a  passer  bye,  Ganga  Prasad  (PW-10)  was  an<br \/>\nemployee of  Ramashish and  Birendera (PW-11)  is the son of<br \/>\nRamashish.   All of  them rushed  to his  &#8216;Gaddi&#8217;  on  their<br \/>\nattention being attacked by the sound of firing of shots and<br \/>\nexplosion  of\tbombs  and  also  by  the  alarm  raised  by<br \/>\nRamashish.   All these\twitnesses had stated that soon after<br \/>\nreaching there\tthey were  informed by Ramashish that he was<br \/>\nattacked by  Tarak nath\t Singh (appellant No.1), Chhabi Nath<br \/>\n(appellant No.2)  and four  to five  unknown persons.\t The<br \/>\ntrial  court   held  that  the\tevidence  of  Ramashish\t was<br \/>\ncorroborated  by  the  medical\tevidence  and  also  by\t the<br \/>\nevidence  of   the  aforesaid  witnesses.    It,  therefore,<br \/>\nconvicted the appellants as stated above.\n<\/p>\n<p>     The  High\t Court\tagreed\t with  appreciation  of\t the<br \/>\nprosecution evidence  by the  trial court  and confirmed the<br \/>\nfindings recorded  by it that the appellants along with four<br \/>\nof five\t other persons\thad attempted  to cause the death of<br \/>\nRamashish Singh\t as alleged against them.  It, however, held<br \/>\nthat conviction\t of appellant Tarak Nath Singh under section<br \/>\n25 and\t27 of  Arms Act was bad because the sanction granted<br \/>\nby the\tDistrict Magistrate  was bad in law.  It, therefore,<br \/>\nacquitted Tarak\t Nath Singh f those charges.  As regards the<br \/>\nsentence imposed  upon the  appellants the High Court was of<br \/>\nthe view  that it was rather harsh and therefore, reduced it<br \/>\nas stated above.\n<\/p>\n<p>     Mr. Rajinder  Sachhar, learned  senior counsel  for the<br \/>\nappellants, contended  that both  the courts below failed to<br \/>\nappreciate that the prosecution had failed to establish that<br \/>\nan emergency light was burning in the &#8216;Gaddi&#8217; at the time of<br \/>\nthe incident.\tHis submission was that admittedly there was<br \/>\nload shedding  in the  area at\tthe time of the incident and<br \/>\ntherefore, it  was incumbent  upon the\tprosecution to prove<br \/>\nthat in the &#8216;Gaddi&#8217; of Ramashish there was a source of light<br \/>\nsufficient  enough   to\t identify   the\t assailants.\t The<br \/>\nInvestigating Officer had neither seized any emergency light<br \/>\nfrom the  &#8216;Gaddi&#8217; nor  had made\t any inquiry in that behalf.<br \/>\nWe do  not find\t any substance\tin this contention as it was<br \/>\nnot at\tall necessary  for the\tpolice to  seize and produce<br \/>\nbefore the  Court the said emergency light. Undisputedly the<br \/>\n&#8216;Gaddi&#8217; of  Ramashish was  open as  the incident  had  taken<br \/>\nplace inside  the &#8216;Gaddi&#8217; and it was unlikely that at such a<br \/>\nlate hour  Ramashish was  sitting in his &#8216;Gaddi&#8217; without any<br \/>\nlight.\t It was\t not even  suggested to\t PWs-1,2,3,10 and 11<br \/>\nthat there  was no  light in  the Gaddi\t at the\t time of the<br \/>\nincident or  when they\treached there.\tBoth the courts have<br \/>\nbelieved the  evidence of  the witnesses and held that there<br \/>\nwas light  in the  &#8216;Gaddi&#8217; and\twe see\tno reason  to  doubt<br \/>\ncorrectness of that finding.\n<\/p>\n<p>     It was  next contended  that Ramashish was really taken<br \/>\nto the\thospital not  by his  son Birendera  but by Jagdish,<br \/>\nson-in-law of  the elder brother of Ramashish, and that till<br \/>\nRamashish was  admitted in  the emergency  ward names of the<br \/>\nassailants were\t not known either to Ramashish or Jadgish as<br \/>\ndisclosed by  the  discharge  certificate  and\tthe  medical<br \/>\ncertificate, which  contained history of the assault but did<br \/>\nnot contain  the names of assailants.  It was also submitted<br \/>\nthat Birendera\treally did  not know  about the incident and<br \/>\nhad not gone to the hospital at all and to support his false<br \/>\nclaim the  prosecution had  examined Shewnarayan (PW-2).  It<br \/>\nis true\t that in  the discharge\t certificate prepared by the<br \/>\nhospital it  is mentioned  that the person who got Ramashish<br \/>\nadmitted in  the hospital  was one  Jagdish but from that it<br \/>\ndoes not necessarily follow that Birendera had not taken his<br \/>\nfather to  the hospital.   the evidence of Birendera on this<br \/>\npoint is  not only  supported by the evidence of PWs-1,3 and<br \/>\n10 but\talso by\t the evidence  of PWs-4,  5 and\t 14.   Jahar<br \/>\nBanerjee (PW-4) was an employee of Calcutta Medical Research<br \/>\nInstitute,  where   the\t injured  Ramashish  was  taken\t for<br \/>\ntreatment.   He has  stated that  he had  seen a private car<br \/>\narriving at  that place\t with  one  person  having  bleeding<br \/>\ninjuries.   Kalisankar Dhar  (PW-5) was\t another employee of<br \/>\nthat Institute\tworking in  the emergency department and has<br \/>\nstated that  on being  informed\t that  a  patient  had\tbeen<br \/>\nbrought in  a serious condition he had gone with a stretcher<br \/>\nand taken him to the emergency department.  According to his<br \/>\nevidence the  patient had  bleeding injuries and the man who<br \/>\nwas with  him had  helped him  in getting down from the car.<br \/>\nThat man  had no  money and, therefore, had gone back in his<br \/>\ncar to\tbring money.  he identified that person as Birendera<br \/>\nSingh, in the court.  In cross-examination he further stated<br \/>\nthat he\t saw one  person in  the car besides the patient and<br \/>\ndenied that Birendera Singh, identified by him in the court,<br \/>\nwas not\t the person who was with the patient.  Sub Inspector<br \/>\nDinesh Chakraborty  (PW-14) had\t stated in his evidence that<br \/>\non receiving information about the incident be had rushed to<br \/>\nthe &#8216;Gaddi&#8217;  of Ramashish  and at  that\t time  he  had\tseen<br \/>\nRamashish lying\t in a  car in  injured condition and his son<br \/>\nBirendera Singh\t was making  necessary arrangements  to take<br \/>\nhim  to\t  the  hospital.     The  evidence  of\tthese  three<br \/>\nindependent witnesses  was not\tat all\tchallenged.  It was,<br \/>\ntherefore, satisfactorily  established\tby  the\t prosecution<br \/>\nthat Birendera\tSingh after taking his injured father to the<br \/>\nhospital had  gone back\t to his house to get some money.  It<br \/>\nis quite  possible that\t Jagdish (son-in-law  of  the  elder<br \/>\nbrother of Ramashish) and Madan (son of the elder brother of<br \/>\nRamashish who had also by that time arrived at the hospital,<br \/>\nas stated  by Birendera\t himself, might\t have volunteered to<br \/>\ngive the  history of assault to Dr. Tapan Bhattacharjee, who<br \/>\nhad prepared the necessary case papers.\t The defence version<br \/>\nthat it\t was Jagdish,  who had\ttaken injured Ramashish from<br \/>\nthe &#8216;Gaddi&#8217;  to the  Hospital, has not been accepted by both<br \/>\nthe courts  below.   We are  also of  the view that the said<br \/>\nversion was  rightly not  believed. Once  we believe that it<br \/>\nwas Birendera Singh who had taken his father to the hospital<br \/>\nthe contention raised by the learned counsel with respect to<br \/>\nthe evidence  of Shewnarayan (PW-2) has to be rejected.\t The<br \/>\ncontention that\t names of the assailants were not known even<br \/>\nto  Ramashish\ttill  he   was\tadmitted  in  the  emergency<br \/>\ndepartment also has to be rejected.\n<\/p>\n<p>     It was  next contended  by\t the  learned  counsel\tthat<br \/>\nRamashish was about 58 years old at the time of the incident<br \/>\nand, therefore,\t after receiving  injuries on  his hands and<br \/>\nface as\t a result of firing of bullets from the revolver and<br \/>\nafter being stabbed by a knife on his abdomen could not have<br \/>\noffered any  resistance and  therefore his  evidence that he<br \/>\nhad snatched  away the\tknife from  the hands  of one of the<br \/>\nassailants and caused injury to him cannot be believed.\t The<br \/>\nevidence discloses  that even after receiving those injuries<br \/>\nRamashish had  not fallen  down and  he was in a position to<br \/>\nhand over  money  and  the  papers  containing\taccounts  to<br \/>\nShewnarayan (PW-2),  Moreover, it  was not put to any of the<br \/>\ndoctors who  had examined  Ramashish  that  after  receiving<br \/>\ninjuries he  could not\thave offered  any  resistance.\t  As<br \/>\nstated by  the doctor  on the  basis of\t nature of  injuries<br \/>\ncaused to  Ramashish the bullets fired had little force and,<br \/>\ntherefore, it  cannot be  said that the version of Ramashish<br \/>\nthat he could offer resistance, snatch away a knife from the<br \/>\nhands of  one of  the assailants and caused an injury one of<br \/>\nthem is improbable.\n<\/p>\n<p>     It was  lastly submitted  by the  learned counsel\tthan<br \/>\neven if\t the conviction\t of the appellants is maintained the<br \/>\nsentence  imposed   upon  them\t deserves  to\tbe   reduced<br \/>\nparticularly in\t view of  the  fact  that  the\taccused\t and<br \/>\ninjured are  close relatives  and now  18 years have passed.<br \/>\nHe also pointed out that the appellants had remained in jail<br \/>\nfor a  substantial period  and now  the situation  has\talso<br \/>\nchanged.   During these\t 18 years,  the appellants  have not<br \/>\nbeen involved  in any  offence.\t  Considering the  facts and<br \/>\ncircumstances of  the case,  in our opinion, ends of justice<br \/>\nwould be  met if  the sentence of imprisonment is reduced to<br \/>\nthe period already undergone but a fine of Rs. 10,000\/- each<br \/>\nis imposed upon the appellants.\n<\/p>\n<p>     We,  therefore,   partly  allow   this  appeal.\t The<br \/>\nconviction of  the appellants is maintained but the sentence<br \/>\nimposed upon  them is  altered from rigorous imprisonment of<br \/>\neight years  to rigorous imprisonment for the period already<br \/>\nundergone but  the appellants  are directed to pay a fine of<br \/>\nRs. 10,000\/-  each.   In case  of default of payment of fine<br \/>\nthe appellants\twill undergo  further rigorous\timprisonment<br \/>\nfor a  period of  two years.
