Justice P.N.RAVINDRAN\n\n Dated :20\/10\/2009\n\n O R D E R\n<\/pre>\n<p>                        P.N.RAVINDRAN,J.\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                W.P.(C) No. 29204 of 2009 &#8211; U\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                   Dated 20th October, 2009<\/p>\n<p>                             Judgment<\/p>\n<p>      The petitioner appeared for the final year B.A. degree<\/p>\n<p>examination in Economics conducted by the Mahatma Gandhi<\/p>\n<p>University in April, 2009. The results were published in June,<\/p>\n<p>2009. The petitioner failed in the said examination. He did not<\/p>\n<p>however applied for revaluation in time, since he was employed<\/p>\n<p>in Chennai. After the last date for submission of applications for<\/p>\n<p>revaluation was over, he submitted Ext.P2 letter to the Vice<\/p>\n<p>Chancellor of the Mahatma Gandhi University requesting for<\/p>\n<p>permission to apply for revaluation after the last date. This writ<\/p>\n<p>petition was thereupon filed seeking a direction to the Vice<\/p>\n<p>Chancellor to consider Ext.P2 and pass orders thereon within a<\/p>\n<p>time limit to be fixed by this Court. The petitioner also seeks a<\/p>\n<p>direction to the respondents to accept the application for<\/p>\n<p>revaluation, revalue his answer script and to publish the result<\/p>\n<p>within a time limit to be fixed by this Court.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.29204\/2009          2<\/span><\/p>\n<p>       2. As per the stipulations in Kerala University First<\/p>\n<p>Ordinances, 1998 as in force on 2.10.1983, which for the time<\/p>\n<p>being      governs    the Mahatma   Gandhi    University  also,<\/p>\n<p>applications for revaluation have to be submitted within 21<\/p>\n<p>days from the date of publication of the result. There is no<\/p>\n<p>provision in the Ordinance empowering the Syndicate or the<\/p>\n<p>Vice Chancellor to condone the delay in applying for<\/p>\n<p>revaluation. In the absence of any stipulation in the University<\/p>\n<p>Act to act upon belated applications, the request made by the<\/p>\n<p>petitioner cannot be entertained. I therefore find no reason to<\/p>\n<p>entertain this writ petition.
