DICP Group Centre, Pune, CRPF,<br \/>\ntogether with information regarding payment against that if they consumed them.<br \/>\nIn response, e CPIO Shri S. R. Ojha, DIG, CRPF by a letter dated 03.03.2009<br \/>\ninformed the complainant that the information sought by him was related to an<br \/>\nadministrative matter and as per Section 24(1) of the RTI Act, the act will not<br \/>\napply to security organizations. However, the CPIO informed the complainant<br \/>\nthat the requisite information was called for from Provision Branch of that<br \/>\nDirectorate and due to non availability of any records\/ correspondence with the<br \/>\nsaid Branch, the same has now been called for from GC, CRPF Talegaon, Pune,<br \/>\nMaharashtra and when the information is received the same will be conveyed to<br \/>\nhim. Thereafter vide letter dated 16.03.2009 the information was supplied to the<br \/>\ncomplainant as mentioned by him in his complaint petition to the Commission.<br \/>\nThe complainant has approached this Commission alleging that the information,<br \/>\nas supplied by the CPIO, late by at least 44 days and whatever has been<br \/>\nprovided is incomplete.\n<\/p>\n<p>      Admitting the complaint of Shri Ajay Kumar u\/s 18(1)(e) of the Act the<br \/>\nCommission served notice on CPIO, CRPF, New Delhi on 01.02.2010 for<br \/>\nfurnishing comments. In response, the CPIO has submitted his comments on<br \/>\n09.02.2010. The CPIO has informed the Commission &#8220;Since the information<br \/>\npertained to provisioning hence was sent to Prov. Dte. to collect the information<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n and provide to CPIO, this office initially tried to obtain the information from<br \/>\nProvision Branch of this Directorate but when the same could not be made<br \/>\navailable by the Provision Dte., Group Centre CRPF Pune in Maharashtra was<br \/>\napproached to forward the information. M\/S Jammuna Dass Bool Chand was<br \/>\nalso given an interim reply on 03.03.2009 that information sought by them was<br \/>\ncalled for from Provision Branch of this Directorate General, but due to non<br \/>\navailability any records\/ correspondence with said Branch, the same had been<br \/>\ncalled for GC CRPF Talegaon, Pune in Maharashtra and it was further informed<br \/>\nthat as and when the information as received the same would be conveyed to<br \/>\nthem.\n<\/p>\n<p>        Due to reasons enumerated above, the delay in providing the information<br \/>\nto the firm occurred.&#8221;\n<\/p>\n<p>        The CPIO has enclosed copies of relevant correspondence that took place<br \/>\nbetween different branches of the Force and the complainant.\n<\/p>\n<p>                                Decision Notice<br \/>\n        It is relevant to mention here that the Central Reserve Police Force is<br \/>\nindeed an organization listed at S. No. 10 in the Second Schedule of Right to<br \/>\nInformation Act, 2005 as dealing with security and intelligence, and therefore not<br \/>\ncovered by the Act except for information pertaining to the allegation of<br \/>\ncorruption and violation of human rights. The information sought by complainant<br \/>\nShri Ajay Kumar has made no such allegations. The information sought by the<br \/>\nappellant concerns goods supplied to the force and thus is general information<br \/>\nand as pointed out by CPIO is an administrative issue. Hence, in light of Sec<br \/>\n24(1) this does not lie within the ambit of RTI Act. Nevertheless, the CPIO has<br \/>\nprovided information in accordance with his best judgment. The issue being<br \/>\noutside our jurisdiction this Commission has no grounds to intercede in this<br \/>\nmatter.
