Justice K.T.SANKARAN\n\n Dated :20\/10\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                    ---------------------------------------------\n                    B.A.Nos.5854 &amp; 5889 of 2009\n                    ---------------------------------------------\n              Dated this the 20th day of October, 2009\n\n\n                                 ORDER\n<\/pre>\n<p>     Bail Application No.5889 of 2009 is filed by Babu George and<\/p>\n<p>Sebastian George while Bail Application No.5854 of 2009 is filed by<\/p>\n<p>James George and Shibu George. They apprehend arrest on an<\/p>\n<p>accusation of having committed non bailable offence in Crime<\/p>\n<p>No.271 of 2008 of Santhanpara Police Station.<\/p>\n<p>     2. The learned Public Prosecutor submitted that an extent of<\/p>\n<p>14 acres, which according to the Government, was unauthorisedly<\/p>\n<p>in the possession of the petitioners were taken possession by the<\/p>\n<p>Government. In Crime No.271 of 2008, the petitioners are not<\/p>\n<p>accused persons. There is no intention to arrest them. This<\/p>\n<p>submission is recorded and the Bail Applications are closed.<\/p>\n<p>     3. It is also submitted by the learned Public Prosecutor that if<\/p>\n<p>during the course of investigation, it is revealed that the petitioners<\/p>\n<p>are involved in the offence, then only the investigating agency<\/p>\n<p>would proceed against the petitioners.
