was further  for  years in favour of father of<\/p>\n

 father of petitioner filed a suit in<\/p>\n

entitled to possession and that the continuation of “the<\/p>\n

5) The father of R.4 died <\/p>\n

disclose that the grandfather of the petitioner w-a’s~it–hge*.l’4<\/p>\n
owner of the land in question. The land was   A’<\/p>\n
and uncultivated for a period of 2 yeiar’s’.\u00ab The .;Tahasil’dar<\/p>\n
exercising power U\/S.65 of the, BT  <\/p>\n
order dated 26-03-1951 for mani\u00e9iaE\u00a2grnen.t.l”T_h’e
\ngranted lease for a  father
\nof R.4. Later on the  years. The
\nAssistant  lease by 10
\nyears in  that time the Land
\nReforms   and BT & AL Act had<\/p>\n
been repealedll.*–._ii –\n<\/p>\n
  . lglfhelllabove narrated facts categorically disclose<\/p>\n
that”the___R.4iiwas:ln\u00bbe”ver a tenant under the petitioner or his<\/p>\n
 father  any. point of time. In fact the lease was granted<\/p>\n
Tgahasildar\/Assistant Commissioner when the land<\/p>\n
 _wasii’n tinder the management of Government by virtue of<\/p>\n
ifV.cggtlliembrovisions of Sec.65 of BT & AL Act. The father of<\/p>\n
the petitioner had challenged the resumption of land<\/p>\n
U\/S.65 of er & AL Act in O.S.No.203\/1967. DuritthgTthya..ry<\/p>\n

been Karnataka Land Reforms Act 1961.<\/p>\n

   Act is illegal.\n<\/p>\n
