RAMACHANDRAN NAIR, J.\n               ---------------------------------------\n                   W.P.(C) No.1843 OF 2010\n               ---------------------------------------\n           Dated this the 25th day of January, 2010.\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      The petitioner tendered for the work namely, Manning of<\/p>\n<p>Harbour Patrol Launch of CISF in the Cochin Port as per<\/p>\n<p>Exhibit P1 tender notice. It is the case of the petitioner that the<\/p>\n<p>petitioner&#8217;s tender being the lowest ought to have been accepted.<\/p>\n<p>But, there is a move on the part of the respondents for inviting<\/p>\n<p>fresh tenders declining the petitioner&#8217;s tender.<\/p>\n<p>      2. Learned Standing Counsel appearing for the Cochin Port<\/p>\n<p>Trust submitted that after valuation, they have decided not to<\/p>\n<p>accept any of the tenders and the work will be re-tendered. It is<\/p>\n<p>submitted that the lowest quoted rate is higher than what was<\/p>\n<p>prevailing earlier.\n<\/p>\n<p>      3. By Exhibit P5, it was informed to the petitioner that the<\/p>\n<p>Earnest Money Deposit will be released to him on submitting a<\/p>\n<p>hand receipt duly signed affixing one rupee revenue stamp.<\/p>\n<p>Learned counsel for the petitioner submitted that he may be<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.1843\/2010                2<\/span><\/p>\n<p>allowed to participate in the re-tender by accepting the E.M.D<\/p>\n<p>which he has already made pursuant to Exhibit P1.<\/p>\n<p>       Learned Standing Counsel submitted that the same is not<\/p>\n<p>possible, and if the petitioner approaches the competent<\/p>\n<p>authority in response to Exhibit P5, the amount will be disbursed<\/p>\n<p>without any delay.      The same is recorded. The petitioner can<\/p>\n<p>also participate in the re-tender as notified as per Exhibit P4.<\/p>\n<p>       This writ petition is disposed of as above.<\/p>\n<p>                                   T.R.
