JUSTICE RAJAN GUPTA\n\nPresent:     Mr. Hari Om Attri, Advocate, for the petitioners.\n\n\nRajan Gupta, J (oral).\n\n<\/pre>\n<p>             This is a petition under Section 438 Cr.P.C. seeking pre-<\/p>\n<p>arrest bail in a case registered against the petitioners under Sections<\/p>\n<p>489-B and 489-C IPC at Police Station City Hisar, vide FIR No.602<\/p>\n<p>dated 29th May, 2009.\n<\/p>\n<p>             Learned counsel for the petitioners has argued that no<\/p>\n<p>offence under Section 489-B and 489-C IPC is made out. Moreover,<\/p>\n<p>statements of the accused were recorded in police custody and the same<\/p>\n<p>are inadmissible in evidence.\n<\/p>\n<p>             I have heard learned counsel for the petitioners and given<\/p>\n<p>careful thought to the facts of the case.\n<\/p>\n<p>             The    petitioners    were     apprehended       by   Additional<\/p>\n<p>Superintendent of Police, Hisar on 29th May, 2009 on the basis of<\/p>\n<p>information received from an informer. On their personal search, 160<\/p>\n<p>notes of the denomination of Rs.500\/- were recovered from Akram and<br \/>\n<span class=\"hidden_text\">   CRM No. M-26765 of 2009                               2<\/span><\/p>\n<p>100 notes of the denomination of Rs.500\/- were recovered from Mohd.<\/p>\n<p>Sabir. Akram and Mohd. Sabir made a disclosure statement that they<\/p>\n<p>used to get fake currency from Hadar and Amar Ulla alias Rama Tulla<\/p>\n<p>(petitioners herein).\n<\/p>\n<p>             Keeping in view the seriousness of the allegations and<\/p>\n<p>increasing incidents of circulation of counterfeit currency in the country,<\/p>\n<p>I am of the view that custodial interrogation of the petitioner may be<\/p>\n<p>necessary to take the investigation to its logical end. The recovery<\/p>\n<p>being of 260 notes of denomination of Rs.500\/- each, it is important that<\/p>\n<p>the investigating agency should unearth the entire scam. The petitioners<\/p>\n<p>have no case for grant of pre-arrest bail.
