(J)\n\nCITATION:\n JT 1996 (7)   214\t  1996 SCALE  (5)779\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Heard the counsel for the parties.\n<\/p>\n<p>     These appeals  are preferred  by the State of Karnataka<br \/>\nagainst the  judgment of  a Division  Bench of the Karnakata<br \/>\nHigh Court  allowing the  two writ  petitions filed  by\t the<br \/>\nrespondent and\tdeclaring that the Karnataka Inams Abolition<br \/>\nLaws (Amendment)  Act, 1979  (Karnataka Act 26 of 1979) is a<br \/>\nstill-born, void  and invalid Act and declaring further that<br \/>\nthe  Mysore   (Religious  and  Charitable)  Inams  Abolition<br \/>\n(Karnataka Amendment)  Act, 1984 is a superfluous enactment.<br \/>\nIt was\talso declared  by the  High Court  that\t the  Mysore<br \/>\n(Religious and\tCharitable) Inams  Abolition  Act,  1955  as<br \/>\namended in  1969 remains  unaffected by\t the Karnataka Inams<br \/>\nAbolitions Laws\t (Amendment) Act,  1979. The decision of the<br \/>\nKarnataka Appellate  Tribunal in  Appeal No.  453  of  1977,<br \/>\nwhich was questioned by the State, was also affirmed.\n<\/p>\n<p>     The respondent  was the  Inamdar of  a large  extent of<br \/>\nland covering  9 villages.  They were  inam lands  and stood<br \/>\nabolished under\t the Inam  Abolition Act,  1955 with  effect<br \/>\nfrom  1.4.59.  The  main  dispute  herein  pertains  to\t the<br \/>\ndetermination  of   the\t Basic\t annual\t sum  to  which\t the<br \/>\nrespondent is  entitled to. By an order dated 1st September,<br \/>\n1957 the  Deputy Commissioner  fixed the Basic annual sum at<br \/>\nRs. 2,815\/-.  After the\t coming into  force of the Amendment<br \/>\nAct 33\tof  69,\t which\tinter  alia  inserted  Section\t21-A<br \/>\nproviding for  review of  the orders  determining the  Basic<br \/>\nannual sum,  the  respondent  filed  a\trevision  which\t was<br \/>\nallowed by  the Deputy\tCommissioner by\t his order dated 5th<br \/>\nMay, 1976.  Under this\torder the Basic annual sum was fixed<br \/>\nat Rs.\t1,94,875\/-. An\tappeal preferred  by  the  State  of<br \/>\nKarnataka against  the order  of the Deputy Commissioner was<br \/>\ndismissed by the Appellate Tribunal. Then followed Amendment<br \/>\nafter Amendment, which it is not necessary to trace here for<br \/>\nthe reasons mentioned hereinafter. (Act 26 of 79 was enacted<br \/>\nand then  came Act  24 of  1984 and ultimately the Amendment<br \/>\nAct of\t1995, the last-mentioned during the pendency of this<br \/>\nmatter in  this Court).\t The High  Court has dealt with both<br \/>\nthe Amendment  Acts viz.,  Act 26 of 79 and Act 24 of 84 and<br \/>\nhas made  certain  declarations\t and  directions.  The\t1995<br \/>\n(Amendment) Act,  of course, was enacted and came into force<br \/>\nafter the impugned judgment was delivered by the High Court.<br \/>\nThe judgment  of the  High  Court  is  assailed\t on  various<br \/>\ngrounds in these appeals.\n<\/p>\n<p>     After hearing  the parties,  we are of the opinion that<br \/>\nit  is\t not  necessary,   in  the   particular\t facts\t and<br \/>\ncircumstances of  this case,  to go  into  or  consider\t the<br \/>\nseveral contentions  raised in\tthese appeals,\tor for\tthat<br \/>\nmatter, considered  and pronounced  upon by  the High Court.<br \/>\nHaving regard to the extend of the land concerned herein and<br \/>\nall the relevant facts and circumstances, we are inclined to<br \/>\nthink that  the determination of the Basic annual sum at Rs.<br \/>\n1,94, 875\/-  is reasonable  and\t adequate.  Accordingly,  we<br \/>\ndismiss these  appeals without expressing any opinion on any<br \/>\nof the\tcontentions raised  in these  appeals or,  for\tthat<br \/>\nmatter, upon  those considered\tand adjudicated\t upon by the<br \/>\nHigh Court. Similarly we do not express any opinion upon the<br \/>\neffect and validity of the Mysore (Religious and Charitable)<br \/>\nInams  Abolition   Karnataka  Amendment\t  Act,\t1995   being<br \/>\nKarnataka Act  29 of  1995. The\t said questions\t may be gone<br \/>\ninto in an appropriate case.\n<\/p>\n<p>     The appeals  are accordingly  dismissed subject  to the<br \/>\nabove observations.
