3. Defendant”    contending
\ninter alia that  of land in Sy. No.l34\/ 1<\/span>
\nfrom  andhlthverefore had become the
\nabsolute owner of measuring 0.4.65 guntas. He<\/p>\n
furtherycontenldedv that under a sale deed dated 18.08.2003 Sri<\/p>\n

 conveyed 0.4.65 guntas of land in his<\/p>\n
  favour\ufb01fandp”xa.s*:: such he asserted that himself and his<\/p>\n
predecessor=;:in~title had absolute title to the property and<\/p>\n
  plaintiffcannot claim any portion of the property comprised in<\/p>\n

 After the evidence commenced and defendant No.3<\/p>\n
produced the registered sale deed dated 18.08.2003. plaintiff<\/p>\n

very same  to him which he had purchased<\/p>\n
__in 199.9!has been again sought to be sold by defendant No.2 in<\/p>\n

\nsuch circumstances,   held that such
\namendment could not be    circumstances
\nof the present haye no parallel to the
\nfacts and    decided by the Apex<\/p>\n
