PUBLIC PROSECUTOR for\nRespondent \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tIn the<br \/>\nfacts and circumstances of the case and by consent of both the sides,<br \/>\nthis matter is taken up for hearing today.\n<\/p>\n<p>\tThis is an<br \/>\napplication for anticipatory bail under Section 438 of the Code of<br \/>\nCriminal Procedure in connection with the FIR bearing CR No. I &#8211;<br \/>\n6 of 2004 registered with Bhuj ACB Police Station for the offences<br \/>\npunishable under Sections 406, 409, 420, 465, 468, 437, 34 114 and<br \/>\n201 of the Indian Penal Code and under Sections 7, 12, 13(1)(c)(d)<br \/>\nand Section 13(2) of the Prevention of Corruption Act.\n<\/p>\n<p>\tMr. Saurin<br \/>\nA. Shah, learned advocate for the applicant submitted that the<br \/>\napplicant is  an innocent person and has not committed any offence as<br \/>\nalleged in the FIR and he has been wrongly arraigned in the<br \/>\ncommission of the offence.  In view of the aforesaid facts and<br \/>\ncircumstances of the case, it is a fit case to release the present<br \/>\napplicant\/s on anticipatory bail.\n<\/p>\n<p>\tMr.H. H.\n<\/p>\n<p>Parikh, learned Additional Public Prosecutor representing the State<br \/>\nsubmitted that considering the role attributed to the applicant which<br \/>\nis reflected in the FIR at Annexure-A to the application and the<br \/>\nnature of offences in which the applicant is  involved as well as the<br \/>\nmanner in which the offences are committed by the applicant, the<br \/>\napplication deserves to be rejected.\n<\/p>\n<p>\tHaving<br \/>\nconsidered the rival submissions and on perusal of the FIR at<br \/>\nAnnexure-A to the application, the applicant is  booked for the<br \/>\noffences punishable under Sections 406, 409, 420, 465, 468, 437, 34<br \/>\n114 and 201 of the Indian Penal Code and under Sections 7, 12,<br \/>\n13(1)(c)(d) and Section 13(2) of the Prevention of Corruption Act.<br \/>\nIn view of the above facts and circumstances of the case and without<br \/>\nentering into merits of the case, I am inclined to exercise my<br \/>\ndiscretion in favour of the applicant\/s.\n<\/p>\n<p>\tIn the<br \/>\nevent of arrest of the applicant in connection with CR No. I &#8211;<br \/>\n6 of 2004 registered with Bhuj ACB Police Station for the offences<br \/>\npunishable under Sections 406, 409, 420, 465, 468, 437, 34 114 and<br \/>\n201 of the Indian Penal Code and under Sections 7, 12, 13(1)(c)(d)<br \/>\nand Section 13(2) of the Prevention of Corruption Act,  he shall be<br \/>\nreleased on bail on executing a bond of Rs.10,000\/-  [Rupees ten<br \/>\nthousand only] with one surety of the like amount on the following<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 27.09.2010<br \/>\nat 11:00 a.m.<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat the<br \/>\ntime of execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, he\/she\/they shall surrender the same before the Trial Court<br \/>\nwithin a week;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>\tIt would<br \/>\nbe open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>\tThis order<br \/>\nwill hold good, if the applicant is arrested at any time within 90<br \/>\ndays from today.  The order for release on bail will remain operative<br \/>\nonly for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the applicant to make a fresh<br \/>\napplication for being enlarged on bail in usual course, when it comes<br \/>\nup before the competent Court, will be decided in accordance with<br \/>\nlaw, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>\tWith these<br \/>\ndirections, this application is allowed.
