In short, it is their contention that the<br \/>\nimpugned orders have been passed in clear violation of the principles<br \/>\nof natural justice and complete non-application of mind.\n<\/p>\n<p>3.0\t\tI<br \/>\nhave heard learned counsel for the parties and perused the documents<br \/>\nplaced on record. When the statutory authority has been empowered to<br \/>\nhear the appeal against the order of the Deputy Collector, the<br \/>\nauthority ought to have taken a practical view of the matter and<br \/>\nought to have considered the appeal on merits. It is required to be<br \/>\nnoted that the higher authority is required to consider the decision<br \/>\nof the lower authority on merits in order to give substantial justice<br \/>\nto the parties.\n<\/p>\n<p>3.1\t\tIn<br \/>\nview of the above, the impugned order dated 31.12.2001 passed by<br \/>\nrespondent no.1 as also the order dated 16.04.2004 passed by<br \/>\nrespondent no.2 are quashed and set aside. The matter is remanded to<br \/>\nthe Appellate Authority for decision afresh. The Appellate Authority<br \/>\nis directed to decide the said application of the petitioners for<br \/>\ngranting exemption u\/s. 32(B) of the said Act in accordance with law<br \/>\nand after hearing the petitioners as early as possible. Since the<br \/>\nappeal in question would be time-barred, the Appellate Authority<br \/>\nshall decide the delay condonation application on merits instead of<br \/>\nrejecting the same on technicalities. With the above directions, the<br \/>\npetitions stand disposed of. Rule is made absolute to the aforesaid<br \/>\nextent with no order as to costs.\n<\/p>\n<p>(K.\n<\/p>\n<p>S.
