Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/07\/2007\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                    -------------------------------------------\n                        O.P.No.32647 OF 2000\n                    -------------------------------------------\n                Dated this the 24th day of July, 2007\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The complaint of the petitioner is that there had been<\/p>\n<p>unauthorised or excessive deduction of income tax from the<\/p>\n<p>amounts payable to him. Learned counsel for the K.S.E.Board<\/p>\n<p>states that the amounts deducted have been credited to the<\/p>\n<p>Revenue.     Under such circumstances, after hearing learned<\/p>\n<p>counsel for the petitioner, learned Government Pleader and<\/p>\n<p>learned standing counsel for Income Tax Department, this writ<\/p>\n<p>petition is disposed of directing that if the petitioner files a<\/p>\n<p>revised return for the relevant period in question and produces<\/p>\n<p>the T.D.S. certificate, the Income Tax Department will consider<\/p>\n<p>refunding the amounts found due, on appropriate indemnity<\/p>\n<p>being executed by the petitioner in favour of the Income Tax<\/p>\n<p>Department. Necessary statutory application to condone delay<\/p>\n<p>will also be filed, if necessary, and such application will be taken<\/p>\n<p>into consideration by the competent authority.                   The T.D.S.<\/p>\n<p>certificate will be issued by the Board within a period of one<\/p>\n<p>OP.32647\/00<\/p>\n<p>                           Page numbers<\/p>\n<p>month from now and the petitioner shall file return as aforesaid<\/p>\n<p>within a period of two months from now.
