And Others\nPetitioner Counsel :- Sandeep Srivastava\nRespondent Counsel :- C.S.C.\n\nHon'ble Shishir Kumar,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and learned Standing<br \/>\nCounsel.\n<\/p>\n<p>This Court after considering the facts and circumstances of the<br \/>\npresent case has passed a very detailed order on 29.06.2010. The<br \/>\nCourt has also directed the Superintendent of Police, Mirzapur to<br \/>\nappear before this Court to show that under what circumstances,<br \/>\nthe petitioner has been permitted to join after a period of 14 years<br \/>\nwithout any order passed by any authority or Court, in spite of the<br \/>\nfact that he was transferred from Varanasi to Mirzapur by order<br \/>\ndated 30.06.1995 and was relieved on 26.08.1995. From the record<br \/>\nit is clear that the petitioner was absent from duty without any<br \/>\ninformation to the authorities and deliberately has not joined the<br \/>\ntransferred post and now due to mistake of the Superintendent of<br \/>\nPolice, Mirzapur he has been permitted to report to police line on<br \/>\n11.11.2009 and now the petitioner wants to take the benefits that<br \/>\nas he has been permitted to join therefore period of absence of 14<br \/>\nyears may be treated as medical leave or leave without pay.<br \/>\nThough the Court on that occasion taken a view that a mistake has<br \/>\nbeen committed on the part of the committee to permit the<br \/>\npetitioner to join .\n<\/p>\n<p>Learned Standing Counsel Sri B.N. Mishra states that the<br \/>\ndisciplinary enquiry regarding a long absence of period of 14 years<br \/>\nflouting the orders of transfer dated 30.06.1995 is still pending<br \/>\nagainst the petitioner. Therefore, it will be appropriate that the<br \/>\nproceeding against the petitioner may be permitted to complete<br \/>\nand the proper action as provided under the law may be taken.<br \/>\nPetitioner now only on the basis of joining claims that he is<br \/>\nentitled for salary also. In my opinion, unless and until the period<br \/>\nof absence of the petitioner for a considerable long time is not<br \/>\ntaken into consideration the petitioner will have no right to claim<br \/>\nthe continuity of service or salary in case the some mistake has<br \/>\nbeen committed by the authority permitting the petitioner to join.<br \/>\nFrom the record it clearly appears that no plausible reason or<br \/>\nground has been submitted by the petitioner for a long absence and<br \/>\n there is nothing on record to show that in case the petitioner was ill<br \/>\nor as according to the petitioner he was mentally disturbed any<br \/>\ninformation to the relevant authority regarding his illness and<br \/>\ncondition, not to join the post, has ever been intimated. The<br \/>\npetitioner has submitted no proof before this Court to show that<br \/>\nwell in time immediately after the order of transfer in the year<br \/>\n1995 any application was sent that was received in the office of the<br \/>\nrespondents. Therefore any explanation which is being given by<br \/>\npetitioner as on today by means of this writ petition by annexing<br \/>\ndocuments can be treated to be afterthought.\n<\/p>\n<p>In such circumstances, in my opinion, the disciplinary enquiry<br \/>\nagainst the petitioner may be completed by the respondents-<br \/>\ncompetent Authority after giving opportunity to him and suitable<br \/>\norder be passed taking all the situations regarding unauthorized<br \/>\nabsence of petitioner and in case the disciplinary authority comes<br \/>\nto the conclusion that a suitable punishment according to law is to<br \/>\nbe given to the petitioner, the same be imposed while passing the<br \/>\nfinal order. It is further provided that in case there is any<br \/>\napprehension in the mind of the respondents that during the<br \/>\ndisciplinary proceeding pending against the petitioner there is any<br \/>\napprehension of absconding the petitioner, respondents are at full<br \/>\nliberty to detain petitioner till the disciplinary proceeding is<br \/>\ncompleted. It is further observed that if possible the disciplinary<br \/>\nproceeding be completed within six months from the date of<br \/>\nproduction of a certified copy of this order.\n<\/p>\n<p>The presence of S.P., Mirzapur is hereby exempted.\n<\/p>\n<p>With these observations, the writ petition is hereby dismissed.\n<\/p>\n<p>No order as to costs.\n<\/p>\n<p>Order Date :- 15.7.2010<br \/>\nSazia\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ram Narain Prasad vs State Of U.P.
