Special Civil Application No. 12311 of 2001\n          MR PRASHANT G DESAI for Petitioner No. 1\n          GOVERNMENT PLEADER for Respondent No. 1\n\n\n     --------------------------------------------------------------\n\n\n                CORAM : MR.JUSTICE J.N.BHATT\n                                   and\n                        MR.JUSTICE H.H.MEHTA\n\n\n                Date of Order: 25\/11\/2002\n\n\nORAL ORDER<\/pre>\n<p>                     (Per : MR.JUSTICE J.N.BHATT)<\/p>\n<p>     These two matters are notified pursuant to the<br \/>\n     notes given by the learned Advocate for the purpose of<br \/>\n     withdrawal on account of the fact that the regularization<br \/>\n     proceedings in relation to the land in question are<br \/>\n     pending before the District Magistrate, Collector Office,<br \/>\n     which has desired to first withdraw both these petitions.<br \/>\n     Such an application is also given and placed on record.\n<\/p>\n<p>     We have gone through the said application, the<br \/>\n     notes.   In view of the aforesaid aspect, the learned<br \/>\n     Counsel Mr. Desai seeks permission to withdraw these two<br \/>\n     petitions which are pending with the liberty reserved in<br \/>\n     case of any adverse decision and that time bound frame<br \/>\n for disposal of on going proceedings   for   regularization<br \/>\nmay be directed.\n<\/p>\n<p>Both these applications are permitted to be<br \/>\nwithdrawn at this stage.     Obviously, therefore, both<br \/>\nthese petitions require to be dismissed as withdrawn on<br \/>\nthe aforesaid grounds.   The concerned officer dealing<br \/>\nwith regularization proceedings shall accord priority to<br \/>\nthese matters and dispose of such       proceedings   as<br \/>\nexpeditiously   as   possible in accordance with law.<br \/>\nLiberty in case of any adverse decision is obviously<br \/>\nreserved. Both these petitions therefore stand dismissed<br \/>\nas withdrawn.    Rule is discharged.
