ANAND, J.\n<\/pre>\n<p>            The petitioner-prisoner applied for parole in order to able to<\/p>\n<p>attend the marriage of his brother-in-law&#8217;s daughter (wife&#8217;s brother&#8217;s<\/p>\n<p>daughter) to be solemnised on 3.11.2008.\n<\/p>\n<p>            Notice of motion.\n<\/p>\n<p>            On the asking of the Court,       Mr. S.S.Mor, learned Senior<\/p>\n<p>Deputy Advocate General,          Haryana accepts notice on behalf of<\/p>\n<p>respondents.\n<\/p>\n<p>            There is a precise averment in the course of the petition that<\/p>\n<p>petitioner is undergoing incarceration for the last about three years and he<\/p>\n<p>has not availed of parole during this period. It is also averred otherwise he<\/p>\n<p>has not committed any jail offence either during that period.<\/p>\n<p>            The petition shall stand disposed of accordingly with the<\/p>\n<p>following directions to the competent authority:-<\/p>\n<blockquote><p>      a)    The respondents shall ascertain the correctness or otherwise<\/p>\n<p>            of the averment made by the petitioner;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Misc. No.M-27924 of 2008                             -2-<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                     ****<\/p>\n<\/blockquote>\n<blockquote><p>      b)    If the factual averment is found to be correct, the petitioner<\/p>\n<p>            shall be released on parole for a reasonable period to enable<\/p>\n<p>            him to attend the marriage of daughter of his brother-in-law<\/p>\n<p>            (wife&#8217;s brother&#8217;s daughter) to be solemnised on 3.11.2008. If<\/p>\n<p>            the averment is found to be factually incorrect, the competent<\/p>\n<p>            authority may pass an order to the contrary.<\/p>\n<\/blockquote>\n<blockquote><p>      c)    The exercise shall be concluded within a reasonable period<\/p>\n<p>            so that the purpose of grant thereof is not defeated in any<\/p>\n<p>            manner.\n<\/p><\/blockquote>\n<blockquote><p>            It will be for the State counsel to communicate the order to the<\/p>\n<p>            competent authority.<\/p><\/blockquote>\n<p>            Copy of the order be given to the learned State counsel under<\/p>\n<p>the signatures of the Court Secretary.\n<\/p>\n<\/p>\n<pre>October 24, 2008                                     (S.D.
