SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application under Section 5 of the Limitation Act, has been<br \/>\npreferred by the applicants &#8211; original appellants to condone<br \/>\nthe delay of 166 days in preferring First Appeal challenging the<br \/>\njudgement and award dated 1\/1\/2010 passed by learned 3rd<br \/>\nJoint District Judge, Mehsana in Land Acquisition Reference Case<br \/>\nNo.94\/2002.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.K.M.Sheth, learned advocate appearing on behalf of the<br \/>\napplicants; Ms.Pathak, learned Assistant Government Pleader appearing<br \/>\non behalf of respondent No.1 and Ms.Kalpana Brahmbhatt, learned<br \/>\nadvocate appearing on behalf of respondent No.2 and considering the<br \/>\naverments in the application in support of the prayer to condone<br \/>\ndelay in preferring the First Appeal and  so as to give an additional<br \/>\nopportunity to the applicants to submit their case on merits rather<br \/>\nthan non-shutting the same on technical ground of delay, delay caused<br \/>\nin preferring the First Appeal  is hereby condoned.
