RAMKUMAR, J.\n                  = = = = = = = = = = = = =\n                    Crl.M.C..No.539 of 2010\n                 = = = = = = = = = = = = = =\n                  Dated: 25th day of May 2010\n\n                               ORDER\n<\/pre>\n<p>     Petitioners are the accused in O.R.No.46\/2006 of the<\/p>\n<p>Judicial First Class Magistrate Court, Nedumkandam for<\/p>\n<p>offences punishable under Sections 27 (1) (e) (i) of the Kerala<\/p>\n<p>Forest Act 1961, seek to quash Annexure A1 and all further<\/p>\n<p>proceedings in O.R.No.46\/2006 on the file of the Judicial First<\/p>\n<p>Class Magistrate Court, Nedumkanda.\n<\/p>\n<p>     2. It is too early for this Court exercising jurisdiction under<\/p>\n<p>Section 482 Cr.P.C to meticulously scan the voluminous<\/p>\n<p>prosecution records and hold that the prosecution of the<\/p>\n<p>petitioners is groundless and the same is liable to be quashed.<\/p>\n<p>The appropriate remedy of the petitioners is to plead for a<\/p>\n<p>discharge before the Court below.\n<\/p>\n<p>     3. Having regard to the facts and circumstances of the<\/p>\n<p>case, I am inclined to permit the petitioners to plead for a<\/p>\n<p>discharge     in absentia. Accordingly if the petitioners file an<\/p>\n<p>application for discharge before the court below through their<\/p>\n<p>counsel, that court shall not insist on the personal appearance<\/p>\n<p>of the petitioners for the disposal of the discharge petition.<\/p>\n<p>Crl. M.C.
