Soban Asghar, learned<\/p>\n<p>                    counsel    for    the   petitioner,        Shri    Prabhu<\/p>\n<p>                    Narayan    Sharma,      learned     A.C.   to     learned<\/p>\n<p>                    Government Advocate, who appears on behalf<\/p>\n<p>                    of     respondent       no.1\/State        and     learned<\/p>\n<p>                    counsel appearing on behalf of respondent<\/p>\n<p>                    nos.2     and     3\/L.N.     Mithila       University,<\/p>\n<p>                    Darbhanga.\n<\/p>\n<p>                              The     petitioner,       who    retired     as<\/p>\n<p>                    Reader    with     effect    from    28.2.2004       from<\/p>\n<p>                    K.V.S.    College,      Uchaith     Benipatti       under<\/p>\n<p>                    L.N.    Mithila    University,       has   prayed     for<\/p>\n<p>                    directing the respondents to make payment<\/p>\n<p>                    of     differences      of   salary,        arrear     of<\/p>\n<p>                    pension, which is due since the month of<\/p>\n<p>                    March, 2004 to July, 2005 and also gratuity<\/p>\n<p>                    amount.\n<\/p>\n<p>                              Learned counsel for the petitioner<\/p>\n<p>                    submits     that     despite        the    fact      that<\/p>\n<p>                    petitioner retired long back in the year<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>2004,    till      date,     aforesaid         retiral         dues<\/p>\n<p>have    not   been       cleared       by    the     University<\/p>\n<p>authority.      The       petitioner         has    also       filed<\/p>\n<p>representation             before           the       competent<\/p>\n<p>authority, but all went in vain.<\/p>\n<p>           After         hearing       the     parties,         the<\/p>\n<p>court is of the opinion that writ petition<\/p>\n<p>can be disposed of granting liberty to the<\/p>\n<p>petitioner to file a fresh representation<\/p>\n<p>before     respondent           no.2\/Vice           Chancellor,<\/p>\n<p>L.N. Mithila University within a period of<\/p>\n<p>six      weeks           from        today.          If        such<\/p>\n<p>representation is filed, respondent no.2 is<\/p>\n<p>required      to     examine         the     same    and       pass<\/p>\n<p>appropriate        order     in      accordance       with      law<\/p>\n<p>within a period of two months from the date<\/p>\n<p>of filing of such representation. If the<\/p>\n<p>respondent no.2 considers the claim of the<\/p>\n<p>petitioner as genuine, he is required to<\/p>\n<p>pass order for payment of aforesaid amount<\/p>\n<p>within aforesaid time.
