 The’~ea:Se of the claimant is that on 17.7.2004 at<\/p>\n
  7.00 p.m he was travelling in an autorickshaw<\/p>\n
  V _fbearing Regn.No.KA~19A 3250 from Assaigoli to his<\/p>\n
house carrying the T.V which he had taken for repair.<\/p>\n

His case is that, on the way, the said auto capsized,<\/p>\n
as a result, he fell down and injured his left leg<\/p>\n
causing fracture of femur and injury to his krlgee.<\/p>\n
Hence, he \ufb01led the petition seeking
\na sum of Rs.l0 lakhs from respondents?’:”E.._@d <\/p>\n
the court below. In the <\/p>\n

passenger, due to rash and negligent driving<\/p>\n
 of the said autorickshaw by its driver?<\/p>\n
 the petitioner is entitled for<\/p>\n

which of the respondent?\n<\/p>\n

3. The court below after recording the<\/p>\n
evidence and on hearing the counsel for both.___the<\/p>\n
parties, answered issue No.1 in the negative”_Mfor”g:’the<\/p>\n
reason that, in the said accident, the  M<\/p>\n
auto is none other than the”brotheitginwiavv_of=the’1<\/p>\n
claimant. There is nothing on’.__rec_ord shown<\/p>\n
the vehicle was dariiagedgjand that  ‘claimant
\nsuffered injuries in  caused  the driver
\nof the said auto. H   report to<\/p>\n
substantiateflthat the ioffendingwhvehicle was involved<\/p>\n
in the   seenlfrom the evidence of the
\npetitioner  accident the auto capsized<\/p>\n
resulting\ufb02u’in:hfall” of’-the claimant from the said auto,<\/p>\n
   dlid\ufb01 notvmcause even a scratch to T.V the<\/p>\n
    carrying which is highly doubtful and<\/p>\n

 A. accident and the injury that is suffered by the<\/p>\n
 and, the claimant not examining any<\/p>\n
 independent witness to support the fact of accident<\/p>\n
causing injuries to him and as the driver of the said<\/p>\n

 petitioner has failed to prove that he was travelling in<\/p>\n
