DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing CR No.I- 57 of 2010  with  Kalol Taluka Police Station for the<br \/>\noffences punishable under Sections 420, 465, 467, 468, 471 and 120(B)<br \/>\nof the Indian Penal Code.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate for the applicant submits that the applicant is innocent and<br \/>\nhe has been falsely implicated  as accused and he is a bona fide<br \/>\npurchaser and has not forged any document\/s and, therefore, the<br \/>\ncustodial iinterrogation of the applicant may not be  necessary.  The<br \/>\nlearned Advocate also submits that the statement of the applicant is<br \/>\nalso recorded by the Investigating Officer and he would be available<br \/>\nfor trial. The learned Advocate, therefore,  submits that by imposing<br \/>\nsuitable conditions, the applicant may be granted bail.\n<\/p>\n<p>\t\tHeard<br \/>\nthe learned APP for the State.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the complainant has opposed this application for bail on<br \/>\nthe ground that signature of the witness as found in the Power of<br \/>\nAttorney is the person who has purchased the property in question<br \/>\nand, therefore, he cannot be said to be a bona fide purchaser.<br \/>\nBesides, the title in the sale deed about consideration only mentions<br \/>\nabout name of the Bank but does not mention about the Branch of such<br \/>\nBank of which cheque is issued and prima facie, opinion of the hand-<br \/>\nwriting expert is against the applicant.\n<\/p>\n<p>4.\t\tThe<br \/>\nabove submissions on behalf of the complainant are rejected at the<br \/>\nthreshold while exercising powers under section 438 of the Code of<br \/>\nCriminal Procedure inasmuch as there is no bar for a witness signing<br \/>\nPower of Attorney to purchase property and not mentioning name of the<br \/>\nBranch of the Bank in the sale deed or conveyance cannot be presumed<br \/>\nto be a ground for a cause for attracting punishment under the<br \/>\nprovisions mentioned herein.  Besides, opinion of the experts can be<br \/>\nat the most considered by the trial court, which may not be<br \/>\nultimately binding to the trial court and considering  all the above<br \/>\naspects  and  the role attributed to the applicant,     I am inclined<br \/>\nto grant anticipatory bail to the applicant.\n<\/p>\n<p>4.\t\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I-  57 of 2010   registered with with  Kalol Taluka Police<br \/>\nStation,  the applicant shall be released on bail on furnishing a<br \/>\nbond of Rs.5,000\/- (Rupees Five Thousand only) with one surety of<br \/>\nlike amount on following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 22.12.2010  at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.\t\tWith<br \/>\nthese directions, this Criminal Misc.
